Lohan tape recording--pedophiles, money and more

In Pennsyvlania, all parties must consent before tape recording a conversation. However this conversation very likely occured in New York, where Jon has spent a good deal of time lately. In New York, as in most states, it is legal to tape record a phone conversation without the other party's consent, as long as the person taping it is also a party to the conversation. Similarly, federal law allows just one party to consent, but allows states to make state laws to restrict it further, as did Pennsylvania.

What bugs me the most is we are only hearing JON's side of the conversation. We are not hearing what is going on on the other end......

Jon calls Hailey's dog Fender. Hailey tweets about her dog Fender the day after the tape is out. Jon mentions the dog is too near the sidewalk. There are no sidewalks at the Wernresville home.

It's New York. Perfectly legal.

Now instead of whether the recording is legal or not, I wonder what you think of what Jon actually said? Jon thinks he put pictures out there for pedophiles. What horrifies him is that he didn't get paid for it? Hmmmm... Just how much vile behavior do you think we can blame on his emotional abuse?

It seems he lied about when he started his affair with Hailey. And so did she! Why would they do that? What legal ramifications could there be in PA if he is found to have been committing adultery?

I thought Jon was saying that he knew by exposing their children to the public that pedophiles seeing them is a risk they take. Not that they knew of any specific instance of a pediphile targeting the kids, just that, they're aware not everyone watching the show is a 40 something stay at home mom with three kids. Kind of like how women who post photographs of their pregnant belly on their web site should know that not everyone on there is a family member sharing in their joy....some people look at those things for other reasons. I really don't know what to think about his statements taken out of context. They're concerning at the least.

As for the adultery, it really doesn't have much bearing on the divorce in Pennsylvania. If I'm not mistaken, Kate filed for a no-fault divorce, where things like that don't matter much. It might matter if she were trying to get a divorce and he didn't consent, but clearly he wants out, too. Where it might come into play is if Jon were to bring around a bunch of girlfriends on visits or other reckless behavior around the kids. It might affect his leverage in a divorce. But even Kate admits the kids don't know about Hailey, so it doesn't seem to be much of an issue.

I think your interpretation about what Jon meant about pedophiles is right. I don't think he knows any pedophiles using scenes or photos of his kids. Still, don't you think that was a creepy thing to say? He seems unconcerned about the risk, but really angry about the money. He shows what his true motivations are with that comment. TLC will use it to show that he doesn't actually care about the effects of the kids being on TV, just money.

Thanks for the info about adultery in a no-fault divorce. Why do you think they lied about when the affair started? Do you think that's what drove Kate to file? When she filed, it seemed like TLC was caught off-guard, as if something happened the weekend right before she filed. I am glad Kate hasn't pushed this point in interviews: the fact that Jon did, in fact, cheat before she filed. She's never come out and said it, even though she gets asked about Jon's actions and choices.

If I remember something did happen that galvanized Kate to file. She couldn't help herself but release a statement to say passive aggressively, "Jon's activities left me no choice." She filed for divorce right after Jon had the kids with him for Father's Day weekend.

I'm not sure it was ever clear what she was referring to, as she makes it sound like some kind of specific incident on that visit. Cameras weren't around at the time.

The bloggers have been stating for years that filming the children bathing, undressing, swimming, etc. would make them a magnet for pedophiles. Don't tell me that this hasn't occurred to Kate and TLC as well. What's worse is that Kate wanted to continue filming. I'm glad the show is over and that TLC and Kate can't exploit them anymore.
