Jon and Kate's Law: PA Rep. Murt's Child Labor Bill signed into law

Thank you, Rep. Murt, for the more than two years you devoted to this important cause.
A child on reality T.V. is working, not playing.
"Remember, the kids are just playing in front of the cameras, so." Kate Gosselin, Larry King Live, August 25, 2009.

A child on reality T.V. deserves to be paid fairly for their work.

The original TLC contracts provided for payment only to Kate and Jon, not to the children. After more than three years of filming, TLC finally established a trust fund for the children, in November 2009. The Gosselin children first appeared on screen in May 2006.

A child on reality T.V. deserves to have his or her money protected from their parents and others who may seek, either intentionally or unintentionally, to misappropriate it.

A child on reality T.V. deserves to have his or her health, safety, comfort, happiness and education put before obligations to their T.V. show.

Those are just some of the reforms that Rep. Tom Murt has been working for more than two years to get Pennsylvania to understand that they need. Yesterday, Governor Tom Corbett signed House Bill 1548, which affords reality T.V. kids and regular child actors the same protections. Among the reforms, it requires trust funds be set up, a parent or guardian must be allowed within sight and sound of the children at all times (the Gosselins were filmed more than once without Kate or Jon on set), and, perhaps most importantly, requires a studio teacher on set (a licensed teacher), even on reality T.V. shows, to facilitate plenty of time for mandated schoolwork and rest. Finally, an independent set of eyes on our children who are working.

A brief explanation of the hours a kid can work, which were modeled after California's strict laws and have been a little misunderstood in the press: Babies under 6 months can be on set a maximum of 2 hours. Ages 6 months to 2 years old can be on set for four hours, but can only work on camera for two. Ages 2 to 6 can be on set 6 but work just three hours. Kids ages 6 to 9 can work 4 hours a day but are allowed to be on set for 8. Kids age 9 to 16 can be on set for 9 hours, but can only work 5. The rest of the time must be devoted to rest and schoolwork. There is a mandatory rest period of at least 12 hours between consecutive shooting days. So if the family stays up late to film a segment about fireworks until 11 p.m., the children are not permitted to start work again the next day until 11 a.m.

Should the Gosselins ever film again, Kate will find herself facing some big changes on set. Thank you, Rep. Murt!

If she really has sciatica her rainbows and unicorn world is about to burst. It is generally chronic, caused by compression of nerves. If she does have it it is probably due to the pounding of running. I've been amazed that she hasn't reported any knee, foot, muscle problems due to overuse. If she's lying, she's setting the stage to stop running her races all together. But she'll keep obsessively running to keep her weight down.

She didn't think ahead to bring an extra shirt? How about you didn't think ahead to give the kids some dramamine or to know which ones should stay back because they are prone to motion sickness? What a witch

I thought you needed a doctor to diagnose sciatica. Incidentally just saw on facebook this morning one of my friends saying she's going to be the designated driver for awhile because her husband's sciatica is so bad he can't drive. It's not a joke, people are really suffering.

Oh and this is everything we've been saying about running. It can be dangerous and needs to be approved by a doctor. But would she ever mention that to her sheeple, no?

Realitytvkids.com ~ Administrator said...

Localyocul, and, the clip doesn't show it, but how about when all of the kids are that sick you call it a day and TURN AROUND.

Oh but no, Kate had to do her fishing. She left them inside and had her fun. Then when she had had their fun, then they could leave.

But when Kate doesn't like something because her fingers are a little cold, does she stick it out because the kids are having fun? We all know the answer.

Kate is on the "counting my blessings" kick this morning. Reminds me of song from White Christmas:

"When I'm worried and I can't sleep
I count my blessings instead of sheep"

So after a tweetie told her how inspirational her tweets were, Kate tweets:

kateplusmy8
@xxxx aww glad! Sometimes seems like rumblings to me.. But it's what my heart is feeling right this second! :)

I know she meant "ramblings", but rumblings does seem more appropriate:

Defininition of rumblings:

2.An early indication or rumor of dissatisfaction or incipient change: "there are growing rumblings of discontent".

"it's time we stop,
hey what's that sound
everybody look what's goin down"

Admin, thank you for what you do. It's great that you tried to approach Kate on this issue. Too bad "purse boy" chased you away from his precious commodity. As a mother, protecting the children should have been front and center with Kate. Isn't happening, even now. It's all me...me...me...She needs help. It would help her kids, too if she would get it.

I've had family members with sciatica. It was diagnosed and treated by a physician. Wonder if Nurse Kate self-medicates, too? Sad, really.

Good for PA...he moved quickly with this bill and didn't sit around on it, even though he had a period of time in which to sign it.

On another note, what is with the crying sheeple? Yesterday Paige was literally sobbing over hearing kids singing in a car. Today, this one is crying through an interview...

I had not seen it either and was thinking the same thing. So over the top and dramatic, to the point of campy. Her launguage and enunciation and facial expressions were so over the top. What a lousy actress.

And so Kate is complaining of sciatica? Guess she wont be running that upcoming race she needed someway to get out of now that her grifting source fired her ass. My my.

Later tonight she will tweet about how she was busy busy busy anyway coz a hot rockin momma of eight, 8 and have we mentioned EIGHT, just has so much to do and all moms know and hashtag the life of a mom blah blah blah and then those of us with REAL sciatica will know she's lying. Again. Yawn.

For the love of God, Kate.

The government had to step in and pass a bill that forces parents to make wiser choices, otherwise greedy wacko parents like her would continue to exploit their own children.

I just don't understand any mother who would consider showing her own children vommitting on television or anywhere else. No privacy at all was given to the Gosselin children. On the other hand, what kind of people film children doing this? Guess we can all answer that question...TLC, that's who! "Poor taste", as my precious grandma would say. Interesting, Admin, how the body guard shooed you away from Kate for asking a legitimate question, but he didn't protect those children. It was and is all about Kate. So many questions will never be answered. Gets down to money in my opinion.

A couple of years back, I sent a brief email to Rep Murt regarding the need for protection for the Gosselin children (and any other children filming in PA). I signed the email with my real name, town and state. I received a friendly response from Rep Murt, promising to continue to look into the matter, which has always stuck with me because I don't even live in PA. Clearly just a stand-up guy - way to go, Rep Murt!

Please Be Accurate, this is the portion I was referring to. Only a parent or guardian (not just any old rep, an actual legal guardian) can be the one on set to supervise. However, it looks like this was in the draft version and was ultimately crossed out. So you are correct.

The bill DOES say "A PARENT OR GUARDIAN OF A MINOR IS PERMITTED TO BE WITHIN SIGHT OR SOUND OF THE MINOR AT ALL TIMES."

On taking a second look, "permitted" is not the same as "required." This seems to be saying, production has no right to take the kids down to the basement and film them alone if the parent wants to be there. In any case, I will take that out to avoid confusion.

Changing your name to "Please be Accurate" and implying we're trying to mislead is rude IMO.

Thanks for that clip, Admin. An excellent example of why this law is needed. What kind of a parent goes ANYWHERE like this with small kids and not have a change of clothes? That's one thing that always struck me on the show. She claimed to be this organized supermom and NEVER brought a change, no matter where they went - the ice cream drip freak-out at Disney World, The Crayola Factory, this fishing trip. Heck, I'm not a parent and even I know better than to not bring a change of clothing. And she KNOWS that at least some of her kids are prone to motion sickness. It all comes down to that contract. I'm so glad Robert printed it, in its entirety. Seven whole sick days for the entire family -- with 8, mind you, 8 kids! -- and the contract is void if they go over.

Thanks to Rep. Murt and all the legislators who recognized the abuses being perpetrated on the G8 and were willing to take a stand.

Kevin and Jodi, you did the right thing, and one day these kids will thank you for it. God bless you for having the courage to stand up and be counted, regardless of the personal cost.

Just a reminder, we can go and light a candle to thank these courageous people.

She is also continuing to grift rather than spend any of her own dollars for her own large family. No self-awareness. Doesn't care how we feel about her. She is laughing all the way to her bank and her grifted stash of goods in her basement. She doesn't give a rip about what CC CEO said to her publicly. This woman sees any publicity as attention, good or bad. Sad, really, sad. The kids will grow up and get away someday. That time period should be interesting if they talk. Watch out.

Very interesting and when I listened again, yes, that sounds about right. Not a stretch to hear the exchange between the kids.
It tells me that at least some of the kids are starting to realize that their every move should not be made public and when Kate whips out that camera, they know it's going public.

Was pleased to see comments reflect her dumb attempt at singing fame for the six.

When I won the $40 gift card here through Admin's fun contest, and i was looking for something to do with it, I ended up using toward something connected to the USO. Since then I have kind remained active with my local USO. Through them I found this today:

http://www.firstbook.org/

It is a non profit that helps supply a book to children in need. A new book, an appropriate book, that they can keep. It is amazing. Readers, educators, philanthropists (oh and SLPs too!) check out the site. I learned through the USO that USO volunteers are helping with reading aloud to put some of the books on "tape" for disabled children.

All around just such wonderful organizations that help others. And it was my participation in this blog that helped spur me on in that direction.

Hubby commented that he noticed our refrigerator was making a "loud" noise. He speculated that it was a fan and that it wouldn't cost too much to replace.

I put on my Can-Do-Kate hat and looked in the trouble shooting section of the owners manual.

I followed some instructions to remove the cardboard filter panel at the bottom of the frig. Requires something not a screwdriver or fingernails to loosen some rivets. Caution: unplug appliance first.

Holy dust blanket!! I vacuumed the coils, the cords and the fan blades. Cleaned the walls and floors. Then I shouldered the refrigerator back into its little "home".

Hubby was right -- it won't cost much at all to repair and stop the rattle noise. It is gone!

This wasn't my first fix-it for today. I think I'll have a beer!

In a way, I am hopeful and encouraged because it sounds as if someone, somewhere along the way has/is teaching the kids that their "normal" was NOT NORMAL.
Kate can say it's normal all she wants, but at some point, she won't be able to sell that to the kids anymore. They will begin to become aware that people don't poop/pee/vomit for public consumption. Even happy, wonderful moments are private. You can actually have secrets and choose when and what you want to share!!
The children are reclaiming their childhoods and privacy and my bet is that it's Jon and the kids' interactions in his world that are teaching them that.
Oh, a trip to get ice cream and no crew or paps?
Oh, a cook out/bbq and no crew, camera, booms?
Oh, a birthday celebration and no filming?
Hmmm.....I can hear the gears turning in their cute, smart little heads ;-)

If you're a big newer to this cause and this wonderful website, you should know of another brave woman who took a stance against Kate filming her kids far earlier than most. This woman is Nina Frye who hosts the radio show, "Living the Dream Mom".
http://toginet.com/shows/livingthedreammom
Nina was a huge supporter of Kate during and after J+K+8 and I believe even up until K+8, but she had a change of heart, went public on her radio show, and was met with great backlash from Kate's staunch supporters. I'm sure she lost a number of her listeners, but she did a couple shows about why she does not support Kate filming the kids, earning a living off the kids and exposing the kids' pain about the divorce, and then moved on.
So, here's to you, Nina Frye. I hope she learns of Rep. Murt's success in pushing through this law that protects children in reality tv.

Yes, and Kate was photographed in the T shirts. I don't recall Kate's interview with Nina but I do remember being aware that at some point later, Nina took a stance on her change of heart in not supporting Kate's filming the kids anymore.
The tide (beyond folks like us here and other internet communities and news outlets) was far from turning on Kate, so it was a brave action to take so publicly, on the airwaves, knowing the shitstorm she'd face from the likes of her supporters and owners of fan blogs.

Sciatica is really bad. Several years ago I had it and the pain was excruciating. It runs down your leg and freezes you in place. There is no way to be up and about doing normal things. I had to go in the hospital and as you lay on this table on your tummy the Dr. Scans to find the exact spot. He inserts a large needle directly into your spine and he said if it was being done correctly I would feel a burning that should go straight to the place on my leg where the pain was. I thought I would pass out it hurt so bad. But afterwards the pain was gone. It worked! So either she is lying, big surprise, or just trying for some sympathy because no way on Gods green earth could she be running with sciatica!!

WE made Kate beat her infants with a spoon, whip them severely (her words), lift them by their hair, and lock them in cribs with no toys or anything to do, for hours and hours on end.

Or maybe it's all Paul Petersen's fault, as he is trying to promote himself. You know, if only the Pope would learn how to ride Kate's coatails to the world of reality TV and tabloid rags; he could make a little name for himself that way!

There are degrees of sciatica. I've had the kind that puts you to bed with indescribable pain of red hot pokers (both legs at once) and the kind that makes your legs go numb but still very sensitive to touch (I know that makes no sense, but it's true.) Some people only hurt when they move. I hurt 24/7 with mine. I had it back in my 20's, but I remember the pain like it was yesterday. "Ouchy"? That doesn't
begin to describe what I had. I hope hers (IF she has it) is only "ouchy" and tolerable.

The ONLY position I could endure was flat on my stomach. Sitting was impossible, lying down on my back was impossible, standing was impossible.
Problem was, lying on your stomach is the worst
position to be in when you have sciatica. Or at least that's what the doctor said. It causes a worse pinching of the nerve somehow.

In other words, I doubt Kate will be running any races IF she has sciatica. She would be a fool to even try. IF she has sciatica, she needs to be moving very gently, probably in the direction of a medical office.

You are funny! Hatches are the doorways between compartments on ships- they are water tight. We batten down the hatches cuz, IIRC, it's the direction we turn the thingies (aka the battens) on hatches to lock them shut which creates the water tight seal.
Go navy!

In any case Dwindle, we batten down the hatches (and other things)so things are nice and safe during rough seas. Otherwise the ship would be a mess and it would be a dangerous place w/items flying about and the ship being tossed about in heavy seas- not good a mix, LOL

To follow up a bit on Butterfly's thoughts, one of the reasons a person gets sciatica is from weak abdominal muscles.

I got my sciatica from falling off a ladder and landing on both feet. Popped a couple of discs
right out of their homes. My doctor told me to walk - start out walking 5 feet if that was all I could do, but do it, and increase the distance each day. He also gave me some exercises to do for ab strengthening. Within a few months I was walking several miles a day, but the pain was still there if I wasn't very careful.

Ouch, that sounds bad. My case was very mild in comparison. Laying straight is actually what helps,, and being curled up is what made it hurt. I had to learn to stretch out- not my usual position- so uncomfortable for me. If kate has a mild case, she'll be able to run- but like many of you I think it's excuse to not be in the race. She should have picked Plantar Fascitiis or shin splints instead- far more believable- although I run w/ PF, too- not easy but I do it.

I keep checking the weather stations, etc.

For the NJ area and surrounding states:
-------------
"At a minimum, high surf, dangerous rip currents and coastal erosion are likely for a significant portion of the U.S. East Coast," said weather.com meteorologist Nick Wiltgen.

The potential exists for a major coastal storm with heavy rain, high winds, coastal flooding and beach erosion.

Forecasters say it all depends on the track of the storm and how Sandy interacts with a low pressure system approaching the coast.

"In the worst-case scenarios, some part of the Mid-Atlantic and/or Northeast would also see dangerous storm-surge flooding, widespread tree and power line damage from high winds, along with areas of very heavy rainfall," said Wiltgen."
------------------------------------
We've had a tendency here in the middle Atlantic states and the Northeast to assume these coastal hurricanes will turn east and blow out to sea.....because that's what they seem to do so often....and it's made us rather complacent. Owner of a little store I just left about an hour ago hadn't even heard of Hurricane Sandy.

In fact, I've lived in the region all my life and almost every huge snowstorm we've had came out of nowhere...totally unpredicted....whereas we'll get these dire predictions of huge snowstorms and they turn out to be dustings. It's kind of a joke where I live.....if they predict a dusting, we expect a biggie and vice-versa.

I'm sure folks in FLA and the Gulf Coast, for example, take ALL hurricanes equally seriously.

But this is supposed to be some strange "hybrid" with possible "snow (?) involved......and it's been fairly warm here this week...so hard to imagine snow.

You always need to be prepared...you just NEVER know.
And warnings of high winds always scare me. We had one of those derecho-type storms in the early summer this year and literally ripped trees out all over our neighborhood (and knocked the power out for almost 2 days....and blocked us in with huge downed trees blocking roads).

Sciatica is best described as a catch-all term for a range of symptoms that can vary in intensity and location, from the low back, down the buttocks and further to the foot, on one side or both sides. Numbness, pain, loss of reflex and decreased strength can all be symptoms. Bowel and bladder problems are seen in really bad cases.
It does not describe a diagnosis and the causes can range from discogenic to arthritis to muscular tightness/spasm (tumor, arteriol anomolies and others can be zebras and are unlikely). When the pain goes past the knee, nerve compression is highly suspected. Above that, it's a bit of a crap shoot as to what exactly is causing the pain.
All of your accounts are what is seen with the general term of sciatica/low back pain, and your solutions all work--it just depends on the individual and what their own etiology is.
As for Kate, I still say her recovery will be as miraculous as her getting so many babies with so few follicles.
Yes, Kate will de-sciatica.

This message with the blogger logo shows up saying something referring to "editing"....something that sounds like the comment was lost due to editing being done simultaneously on more than one comment being published at the same time as mine (?). This happened a few times yesterday, too, I think.

I'm trying to remember to copy now...before I hit "publish".

I don't know....maybe I'm having "fond" but totally not corroborated by reality memories (incorrect selective memory) of autumn days being mostly clear, chilly, crisp, etc. years ago...and don't remember such extremes in temperature...going back and forth...this time of year. The insects and trees must get confused with these extremes. Feels like it's swinging from really chilly to quite warm every 2-3 days lately.
And it's getting on my nerves....I want these stink-bugs to quit showing back up every few days.

Today is a time to celebrate that, at least in one more state, children's childhoods can't be sold for Juicy Juice, trips or a millionaire lifestyle. In case there would be any doubt in any of the kids' minds, here is the proof that they were victims of neglect, abuse and exploitation.

Admin--do you have an opinion on whether this law will have an impact on future lawsuits the kids might bring against TLC, Jon and Kate? Since the law was passed, does this give grounds because it is clearly the opinion of the state that the TOC contracts did not provide adequate protection for the children. Or, might it hurt their chances because it establishes a timeline for when their activity became illegal?   SInce it would be a civil suit, is there a lowe threshold to prove that their parents were negligent in signing away their rights than required for a criminal prosecution?

By the way, I just googled news for Kate Gosselin for the past week.  Thee were ten entries. Eight of them contained at least one of these words--porn, nude, naked, Vivid Entetainment. One was about being fired. One was a chirpy gather article about a bright future, fun project.

I hope Kate has prepared her tweeties to be on stand-by, sustaining her and telling her how to recharge her phone, making sure she has food and bottled water. We know that she lost all of her trees in the driveway last year, so she shouldn't have to worry about those.

Kate, it is absolutely reprehensible that our state had to exert it's limited resources to pass a bill to keep your exploitation of your children from happening again. You suck and you're a horrible mother.

Hubby has had sciatica since a back injury 6 years ago. He had surgery, which alleviated the back pain, but the sciatica stayed.

When it flares up, it's more than ouchy. It's more like &%$#!!**#$@%*!@#$$$(($! wayward! call the *&&%$^^#*$ chiropractor!

I agree with the rest of the gang, Kate is no longer getting a free ride to LA this weekend, so she googled herself a back ailment. Just like she googled the flag cake. Problem with this ailment is that it is usually a companion to another injury. She is a loser of the highest degree. Thank you, Admin, for explaining the details of the 48 hour week. I still don't like it because I don't think children should be required to be on the set that long, but at least it's a start.

I haven't read all of the comments yet, but I did look at the video clip posted at the top of the thread. It made my blood boil. How could any mother be so uncaring? There she is in her low cut top with her children sick and vomiting, yet she would not tell them to turn the boat around and go back to shore. However, we now from Robert's book, that they may have not been allowed to interrupt the filming, even for illness. However, Kate should have definitely said hey, this will be one of our 7 sick days. This law isn't retroactive, but I think any good lawyer could figure out some way these kids can someday sue PA, TLC and/or the state of PA.

Whether it will work I don't know but there are tons of issues I see that might spark a lawsuit someday.

Everybody on the East coast be safe.

So Kate is having some wine. Then she is lying about sciatica. Why I say that, cause you don't mix wine or liquor with pain killers. But, I guess Kate thinks she is protected. And she is a nurse? I guess memorizing text from a book on nursing can get anyone a certificate. Remember Kate has not done any real practical nursing in 7 years, anyone can take a test. That does not mean you are a nurse. Every time some medical thing or accident has come up, Kate did not know what to do. Or have the child checked out, or rescued the pecked chicken or take the dog to the Vet right away. Anyone who is a nurse your nursing training comes in, for man or beast. And common sense kicks in. Kate has shown that her nursing skills stink.

You can also bet a dollar that if Jon had not said anything to Kate she would have blown up at him and told him everything he did for the child was wrong, wrong, wrong.

Rashes are no fun. I'm assuming this was the case of hives? Ever had hives? They are miserable.

What kind of stay at home mother does not look at her child all day, rash or not? Surely this child passed by her once or twice or sat and scratched and whimpered. What mother is not close enough for that to happen? I don't know.

Day of whine & roses: No, Kate said nothing about taking any pain killers, that is just common sense, if you are in pain, most people take something for it or call their Doctor, and Kate being a nurse, she would be taking something. If I am in pain I take something, in terrible pain, I call Doctor and see what he/she tells me to do.

There is probably nothing wrong with Kate, she is just looking for a way out of the race on sunday. Cause, nobody is flipping the bill for her now. But then Kate just might go anyway, just to get away from the kids.

I went over to the Gather link and listened to the audio Kate taped of she and the kids singing in the BBB. Apparently, Kate did this audio recording, and to the best of my knowledge, the only way it gets out to the universe is if Kate sends it there, right?

Was this recording intended to share her kids joy while driving home from the bus stop? If so, I am unsure what the relevance this audio is meant to achieve. The other confusing thing is Kate's acknowledgement of Shoka. She said hi, but none of her kids chimed in, did they not see the dog, did they not hear their mother's refrain, or was the dog really there at all?

If Shoka was running down the driveway to greet the kids, why did not a single one of them yell out with glee to see him?

So it would appear, but all weather forecasting centers have it headed this way. I hope they are wrong and it takes a last minute turn and goes out to sea. What they are showing are several computer "lines" indicating where the models are predicting it will land. When all of the lines are very close together and all are going in the same general direction, they tend to focus on that because that's where the percentage of models are indicating it will go.

Ex Nurse - It will be interesting to see how everything plays out. Even though Murt's bill has just been signed into law, Jon and Kate had previously violated PA state labor laws by not securing work permits for the kids. The DOL just chose not to fine them or TLC (no doubt because they didn't want to scare production companies away from filming in the state). Kate later applied for the permits, and they were issued in 2010.

Discovery/TLC tried to cover their a$$e$ by writing into the contract that the parents were responsible for obtaining any required work permits. But any reputable company would have made sure that those permits were obtained.
They, of course, were all hiding behind the "children were not working" excuse.

The kids may end up having cases against not only their parents and Discovery/TLC, but against the Commonwealth of Pennsylvania.
