Judge signs off on Kate's agreement to dismiss the lawsuit in full against Jon with prejudice

It's official. The judge signed the dismissal order on Wednesday. All other parties named in the lawsuit are exempt from this dismissal.

Whether any of the kids have mental health issues, therapy is not just for the child. The parents have to be actively involved as well. When she spoke way back when about the kids being in therapy for their issues, she never mentioned one thing about her or Jon joining them. And you know TFW - if she was attending therapy with her kids, she would be shouting to the heavens about what a great mom she was.

Speaking from experience, it is a family issue, not the child's issue to deal with.

If Robert has new posts once or twice a day you would think she would go and hide somewhere. This goes to show he will not back down. He has all the cards and he will not fold them. If I were Kate I would be afraid of what all he has. She is now getting a taste of what she has done to everyone around her.

Also why would this be a big secret anyway... autism affects one in 80 children right now (and climbing daily) and is HARDLY something to feel shameful about or hide.

I can pretty much guarantee that none of the G8 have ASD, and I'm not sure I'm understanding what the big deal would be if they did?!?!

Again, I can't get over how someone is taken to court over federal charges of wiretapping, computer hacking, identity theft and in less than three months, drops all charges. Less than 3 months....multiple federal charges....smh.
Now its back to tweeting rainbow-isms and candy eating, love and giggles.

That's what I thought, and two children were expelled (although I thought is was a suspension). Anyway why would two be expelled if one was exhibiting signs of autism?

Many schools would pull out all the stops to get a child help, if needed. My opinion only - the parents didn't "co-operate", and maybe didn't take the school's concern seriously. Don't tell me that there were not MANY meetings with school officials leading up to the final decision of expulsion. Especially at a pricy private school.

I am willing to bet the communication between TFW’s camp and that of Hoffman’s has slowed. This time is not being used by plaintiff’s counsel to write an answer to defendant’s motion to dismiss, because plaintiff doesn't have one.
I can’t imagine they have much to offer Hoffman.

As a parent of a special needs child, speculation about any child's emotional, physical or mental health does make me uncomfortable but I didn't mean to sound accusatory when I voiced my opinion. I know we show our shared concern for these particular children in different ways and the remarks I referenced were not meant in a mean spirited way at all. Such speculation does make me cringe, but I can scroll with the best of 'em.

No it looks like TFW tweeted about the cards 10/6 . That other person asked about how to send letters and cards today and Paige replied. To Paige's credit, after her visit with TFW, she seems to have gone on with her real life as she had recently before TFW went to Canada.

What TFW doesn't realize is, all the time she yaps on tv about the kids missing the crew, watching 3 to 5 year old DVDs of themselves, and talking about the great trips they had us mediocre people realize not once does she mention Aunts, cousins, grandparents or any normal thing that children should miss. She is so cold and nasty. You know those kids live in the house on a hill with very little interaction with anyone. She makes my blood boil!

OT: NO SPOILERS! The Doctor Who 50th anniversary special episode was on BBC America today, once without commercials and second sowing with commercials and some limited commentary from Matt Smith and David Tennant. It was great, met all my expectations and more. The dh and I watched it twice and got more out of it by watching a second time. The plot is complex, fun, surprising, sad, satisfying. And it sets the stage for the doctor to go in a new direction. I will miss Matt Smith, one more episode and then the Doctor will regenerate into another actor.
If you have ever been a Who fan, check it out, BBC America will be showing the episode several times this weekend.

You know I'm still stuck on the fact that Kate filed her suit and 3 short months later agreed to dismiss. Who does that? I'll tell you who. Someone who thought that Jon would just cave in and she would come out smelling like a rose and could make the talk show circuit saying "See I told you he was the bad guy". What she never in her wildest imagination thought could happen actually did. Jon fought back. So then she was like "OH CRAP" how do I get out of this. The two children were expelled for violent behavior toward other students as well as at least one adult. We don't know all the details. No one is diagnosing them; it was obvious one of the children was different than the others, although all seemed very combative. Whether they have issues or this stems from early experiences at the hands of TFW, who knows. But if they do have issues they must be addressed. I was shocked at the general behavior seen on the show as well as recently on KC. One child shows a lot of atypical behavior. We don't know why- we just hope he gets help.

Inspector Gadget is a famous cyborg policeman with a seemingly endless amount of gadgets he can summon by saying "Go-Go-Gadget" then the gadget's name. The word "Gadget" is actually part of the name, as hinted at in some episodes. Although he has all this equipment, Gadget is ultimately incompetent and clueless (in a manner similar to the Inspector Clouseau character of the Pink Panther series), and overcomes obstacles and survives perilous situations by sheer good luck, with help from his faithful niece Penny and intelligent dog Brain who both must secretly help him solve each case. Even his gadgets often malfunction, which Gadget often deals with by exclaiming that he needs to get them fixed.

I was hypothesizing as I said before, I have no first hand knowledge. I absolutely believe it would be on a very high end function of the scale. However, in Roberts book there is specific evidence and information that the school spent 3 weeks of intensive personal therapy services through the school to try to fix the behavior issues in school. After no advances were made, they had to ask them to leave. I think the diagnosis came after expulsion in the course of intensive therapy and other services.

There is no shame in that diagnosis. However, if a parent does not want the world to know it, for whatever reason, he/she will keep it a secret. Let's face it. Kate has problems admitting that she isn't perfect...she won't admit that anything is not 100% perfect with her children, and no one is perfect.
My last thought, I don't think it really matters why a child is causing a problem in the classroom. If they tried to work it out and could not, and nothing the school did improved the classroom situation, removing them was for the safety and benefit of all involved. The kids, the teachers and other students. Once the behaviors were improved, they went back to school.
I enjoyed hearing your thoughts on the situation too.

It was always disturbing to see how combative the kids were. And unfortunately still are.

My relative who is a TFW clone...her children are very much the same way....so combative. Constantly fighting with each other. It makes me crazy. It's very hard to enjoy them because they spend 99% of their time fighting.

Everyone else refuses to have them together at all. They only take them one at a time. And even then, not very often.
You don't dare say to the parents that the kids acted up because they'll beat the crap out of the little girl. Not physically so much anymore, but certainly emotionally.

There are issues at school also. The school has tried to intervene but the mother will have none of it.

It just hit my radar that TFW and my relative have the same personality, and the same fighting children. Something to ponder. I want so desparately to help the little girl.

I think Kate really thought Jon and Robert conspired against her because the truth is too much for her to bear:
1. She's so ever loving stupid and throwing out the computer was her own foolish fault
2. She is a terrible, abnormal, sick individual who journaled things that shocked, saddened and enraged people
3. No one likes her even a little bit and it's HER fault, not Jon's, robert's, the haters, etc.
4. She is mentally ill and a terrible person
5. Her incredibly insane plot to get fame and fortune has been exposed and has damaged so many lives
6. Her career in tv is probably over and it's HER fault. She's that hatable and was never the attraction in JK8 in the first place

For most parents, those that love their children no matter what, a diagnosis of autism is not something shameful, but rather something to be faced head on. They would want their child to receive the benefit of therapies to help their child reach their highest potential.

But since TFW is as far from a "normal, loving parent" as you can get, and since there is no money to be made by parading around your autistic child, if this were indeed the case with any of the children, she would probably not want to acknowledge it.

I think any behavioral and/or emotional problems the children may have are directly related to the way they have been treated by their mother.

I think this was written with tongue firmly planted in cheek. They are mimicking what Kate has said and would say about these "inaccurate" and "untrue" "trash" stories about her, while at the same time making the point that lots of media outlets have put forth stories like this and she has never tried to sue them.

I did not read Robert's book, but if in fact there is "evidence" of intensive therapy, I hope that someone at that school lost their job for violating HIPAA. As a pediatric nurse practitioner, you should be appalled that any such information has been released.

On the Azure Standard website, under kale, it states "Kale freezes well and actually tastes sweeter and more flavorful after being exposed to a frost."

I guess she doesn't believe the website of the supplier, and must have confirmation from Kate, the know-all, be-all expert at all things frozen.

What "pediatric nurse practitioner" is making an armchair diagnosis of the children's behavior? Is this based solely on clips from the show, never having met or seen these children? I would think, too, that only a child psychologist who has seen these kids, along with their personal physician, would be qualified to make any kind of a diagnosis. Nobody without any personal knowledge of the situation knows if the kids received therapy, how much (intensive or not) and furthermore, if it is true, where it came from is anyone's guess. Moreover, it really isn't anyone's business other than those parties personally involved. To say that nobody has named names doesn't really protect identity...it's been public knowledge as to who the two children were who were taken out of Kindergarten.

Part of the problem of having your children on TV is that their private lives become tabloid fodder. This is why the names of the expelled children are known. By having them on television they also became unfair game for people to dissect their behavior and issues.But I believe those of us who have questioned the why's of their behavior are only interested in their receiving help. It should be a family matter but their mother saw to it that the world knows much of their private business.

HIPPA laws pertain to health care providers, not school employees.

Plus, Robert didn't divulge any specific confidential healthcare information about the kids. If anything, Robert held back and kept many things he knew about the situation to himself - as he promised then and is still doing. While many might use the word "sensational" to describe Robert's book, I would use the word "heartbreaking" or "frightening".

Kate has until the 27th to respond to the Motion to Dismiss. If Kate or the Judge do not dismiss the case then discovery begins. That's why Robert's been posting about discovery on his blog. I think he's looking forward to it.

I agree that most of us here talking about the kids' behaviour are concerned that they may be not getting the help they need. I also believe that those of us who have children with emotional/behavioural issues, know that it is a group effort to get our kids better.

I was just reading the quote Robert has on his site from Kate's recent interview with cupcakemag.com. The interview was done in November, long after the cookbook was published. If I use Kate's past statements where she gives Beth absolutely no credit for MB, I count 4 books.

Kate says in talking about IJWYTK: "Overall, it's my favorite book I've written (on my own on my iPhone as I was traveling, no less) of my three."

The allegations in the amended complaint rely on a conspiracy. How plaintiff's counsel can move forward with that mess, now that they have dismissed all claims against Jon is beyond me.

Right now the answer to the motion to dismiss is on the table.

And by the way things are going, I honestly think plaintiff's attorneys are not anticipating a trial.
For the Gosselin children, who lived through whatever the truth may be I pray this does not go to trial.

Watching Sixty Minutes, interview with Malcolm Gladwell. His new book is David and Goliath:Underdogs, Misfits, and the Art of Battling Giants. It's an interesting premise in his book: having a disadvantage can actually be an advantage because those with the disadvantage have to be more creative. And Gladwell has many examples of how the underdogs actually win conflicts against an opponent with apparent advantages. Interesting concepts. Robert has had to be very creative in taking on TFMJG with her apparent advantages. And he is not done yet!

I understand why at least Jon's portion of the suit really needed to go so he and the children can just go on with their lives. I work in civil lit and deal with HIPAA authorizations frequently, and I always have to double-check myself to be sure I use the proper abbreviation :) HIPPA just seems more natural, maybe because it's close to "hippo"? I don't think anyone needs to be bashed over the head repeatedly with the correct abbreviation - except if one person just wants to yank another person's chain in an attempt to embarrass them?

Before getting all excited about depositions, IF this case does go forward, there is an earlier discovery portion. Each side develops Interrogatories, Request for Admissions and Request for Production of Documents. Much work is involved in this step and this takes a lot of time.

You've got a point! A new tridition and the kids can run around every morning screaming in glee as the find the elf's new location - much like the toddlers she'd have you believe they still are. A horse or a pony are expensive as well as to buy as in upkeep, all the bells and whistles you need and the vet bills can be staggering. So if it is one of those creatures then she'll show that she really doesn't give a hoot how to budget (but maybe she had a coupon)
I just think she likes to cause a big stir and excitement under her handful of followers (+haters) and is blowing something simple out of proportion just to stay relevant...I also vote something that can be kept in a cage, hamster, guineepig, gerbils.
That or a live-in nanny :-)

You know how we speculate (my favorite part) that Milo is either TFW herself, or someone close to her, or someone on her staff.

At one point we were considering whether it was several different persons, in that the tone of Milo isn't consistent. Some days he/she sounds one way, other days he/she sounds pretty passive aggressive, gettin' those digs in.

So now we have it. It's a robot that someone programs with info. We all know TFW can't program to save her soul. So who does that leave? Um, Steve? A variety of paid staff....we all know she can't hang on to staff.

Now needs an indoor small dog so that she can take lots of pictures kissing the dog and cute puppy stories. Not a rescue and to that I say good! Rescues go through a lot before they find a home and they don't want to end up with that bitch.

I have been working, though I have this week off, but have tried to keep up with reading comments. When everyone was mentioning Kate's skinny arm in the Hallmark picture with Cristina and Mark no one said how you could see space and the arm between Cristina and Kate. But she was leaning so close to Mark that she was touching him. And her head is tilted towards him, with a huge smile on her face. It almost looked like Cristina was just in the way, LOL.

Kate is a man eater! Let's see: Mark is cute, a Hollywood guy, has lots of money , seems like a really nice guy, and most importantly has a TV show on the Hallmark channel. Perfect guy! Only negative is that he's married, oh I forgot she doesn't care! Hopefully he'll stay far away!!

I am cooking turkey, Stovetop stuffing because that's what the family likes, cranberry sauce without the berries because I like it, sweet potatoes with marshmallows, sweet potato cornbread because you can't have to many sweet potatoes! Broccoli or peas or maybe both, beets because I like them, the Pillsbury crescent rolls. Trying to decide on apple pie or pumpkin roll for dessert.
So what is everyone else fixing?
True confessions: first time I cooked a turkey, I did not know you had to thaw the thing first! With hot water and plenty of it, I did thaw out that turkey Thanksgiving morning and it did cook and was edible. Not good, but not awful! I love hearing the Thanksgiving disaster stories, it gives families something to laugh about.

This year I'm going to my brother's house so no cooking for me! In the past I've cooked the Jennie-O oven ready turkey. It goes from freezer to oven and was actually pretty good.

We were stationed in Germany for our first Thanksgiving. Since I was going from a family of 9 (7 kids 2 parents) when I made the mashed potatoes I put in only a couple of potatoes but waaaaay too much milk because that's how much my mom put in. We had more a a potato soup! Also, having come from a big family I bought a huge turkey. Since we were living "on the economy", the apartment had this tiny oven and the turkey wouldn't fit. We had to butcher it (and I do mean butcher!) so it would fit and then had to cook it in stages. We still laugh about it.

After a big family reunion last year for Thanksgiving, 2/3 of our immediate family are scattered to the in-laws this year. We have been invited to join our younger daughter and her husband at his family's beach house for the holiday, which is way different, but nice. Bringing a roasted green bean dish and pumpkin pies, and the wine. We will be home on the weekend to prepare a second turkey dinner, must have leftovers and a carcass for soup, plus latkes for Chanukkah. It's a cooking week for sure. Making cornbread this morning for daughter's 'new' stuffing recipe, which we will make tomorrow together.

It is this time of year when I feel particularly sad for the G children. No aunts/uncles/cousins to fill the house and share the holiday. It would be different if they had none, but they do, and it would be wonderful if they had family with whom to interact and form relationships. I understand estrangement, I only know my maternal relatives, but what these kids have is extreme.

Does anyone have a remedy for urinary tract infections? My dr says that antibiotics are being used less often due to the growing resistance to many bacteria. Drinking water, taking cranberry supplements, good hygiene etc are a given.

Since I am prone to them ( since my kidney stones , won't go into that again, lol) just wondered. I know no one is giving medical advice, just suggestions that worked for them! Thanks, gals!

Did your doctor refuse to give to antibiotics?
I used to get UTI's a lot and there is nothing in the world that could have helped besides sulfa drugs.
The infection is not to be trifled with.
Water and cranberry or yogurt are preventative, maybe, at best by fostering an environment that's not friendly for bacteria growth, but the horse is out of the barn once you've developed a UTI.

-I just got around to watching the Hallmark channel show that she was on, and "honestly", um...I had trouble watching it. She was absolutely awful, but then again, the show itself is real snooze fest.

- If she has a stylist, they need to be fired. If she does not, she should hire one ASAP! Both her top and her pants were skin tight. Pick ONE Kate, otherwise you just look like desperate. Everything from her attire to her "performance" on that show just screamed desperation. Oh and the makeup? Why was it on so thick? Between the layers of paint and the overuse of Botox and fillers, she is not doing herself any favors.

- Does anyone know what her real eye color is? In old pictures and even early homemade videos, they look brown, but she has boasted of having the "rarest" color (i.e. see how special I am?) green. Even if her natural color is more of a hazel, she looks to me like she is wearing color contacts.

- IF, and I do mean IF, there is now a horse or some other farm creature living in "Gosselin Land" it could be just a boarder, or some other type of deal where she is allowing the animal to "live" there in exchange for lessons or shared uses. These kind of arrangements are not unheard of. The animals actual owner is responsible for all the feeding and care of the animal, while the property owner either rents them use of the land and barn for a reduced fee, barter of services, or another arrangement (handyman, maintenance, child care, etc.). I highly doubt Kate would pay for anything like this on her own. I also suspect she worked out something with Bullyville or the attorneys so that she would not be on the hook for legal fees either. There sure was some publicity being generated... Just sayin'

Well. if Kate did get a horse, then she just, put the nail in her: I've got no money, poor me coffin. No one will believe that poor me BS again. Like others here have said, perhaps, some poor unfortunate small animal, or perhaps a fish tank. I have guppies, in 2 tanks, and it takes a couple of days to properly set up a tank. Not to mention, buying a tank(if you don't already have one, but then you have to check for leaks), buy gravel, fake plants, filter system, filter cart., solutions for water, and the fish, & their food. Plus a heater, and light, and stand.

I've had Betta fish, they are pretty, but they die too quickly. Compare to my guppies and other tropical fish, even goldfish, Bettas die quicker. Could be some thing in the water, temp, food, stress, that could kill them, or they are old fish. They charge anywhere from $3 to $8 a Betta fish. (depends on how rare or fancy they are). I don't bother with them. With guppies, I know how long they live and I get free replacements, all the time.

He was always just such a nice, funny, likeable guy. Far too nice for TFW, who would just suck the life out of him. Thankfully, he seems to prefer brunettes. If Kate did get a horse/pony, I pity that animal. I own horses, and have all my life. I keep them here on my small farm. The cheapest part about a horse is buying it-and they are not cheap. I am sure Kate would insist on a registered purebred, not a sweet old mixed horse that loves kids. Horses are herd animals, and need a LOT of care and attention, especially if they don't have a companion animal. I wouldn't be surprised if Kate is hoping to have articles in horse magazines, pretend she is an expert in horse care, etc. (Real horse people can spot fakes a mile away) Heck, remember her article on some running magazine after her marathon? I also wouldn't put it past her to hope at least one of her kids can get into the east coast horse show circuit. She thinks she could then 'hob-nob with the wealthy horse people'-my quote of what she probably thinks. Lots of luck with that!

If you look back to her early Surviving Sextuplets show, her eyes are light brown (maybe hazel. Hazel eyes are hard to tell because what color clothes you wear changes the tones brought out in your eyes). I think she has light brown/hazel eyes. If they are grey/green at any point, it's color contacts.

A true thanksgiving story...

Once upon a time, my mother's husband was married to someone else, who left him abruptly after 15 years of marriage and 2 children. Turns out she was having an affair with his friend, who was also his boss, and she was pregnant. It was a very bad day, followed by an angry divorce, and years of bitterness. Armistice was eventually attained, but it was awkward, tense, and cold. Then grand kids arrived and wanted to know why Nana and Papa were always in different rooms on holidays and at their birthday parties. Aghast that even toddlers knew that their truce was fragile at best, Nana and Papa decided to go to dinner together, and work on finding true peace. They both brought along their new spouses too, (even though hers was the former friend/boss, and his was my Mom. It was a slow going and forced at first, but the four of them kept working at it until the relationship and the forgiveness was real and true. Time and the shared love they had for their children and grandchildren had helped to ease the way, but what really clinched the deal was cancer.
She died quickly, and this will be her husbands first holiday without her. Both of them. So they will have it together, all of them. My mother, her husband, his ex wife's husband, and their son.

It's a nice story isn't it? And yes, my mother is wonderful. But she's no saint. Nope. She's just another mom doing the best she can. She knows what divorce is like, having divorced my own father when we were kids. That's not when she truly became a single mom though. No. That happened sometime later...on the Thanksgiving day that he died.

Are you talking about a true UTI or a vaginal infection? If it is a group B strep vaginal colonization, which can show up in a urine culture, your doctor won't treat it unless you have symptoms or are pregnant and going to give birth, for protection of the infant. A "true" UTI requires antibiotics. The most common UTI bacteria is e coli and based on culture and sensitivities, the most sensitive antibiotic can be prescribed to treat. Based on what you said your doctor said, this is the only thing that makes sense to me. I hope that helps.

Speculation on twitter is that Steve put a ring on it so he wouldn't have to testify. How would that work in discovery?

This may have already been answered - but the legal authority that says you cannot compel one spouse to testify against another relates to criminal cases, not civil cases. And from my layman's knowledge, it doesn't mean you can't call them to testify, but only that a prosecutor can't make the spouse testify about incriminating evidence that would put the other spouse behind bars.

I find the twitter universe as regards to Kate fans pretty funny. How can Steve "put a ring on it," when he's still married to Gina? Then following the lack-of-logic trail, so what if he gets a quickie divorce and then marries TFW? They weren't married to each other at the time of any alleged incidents. I'm not sure that spousal privilege is retroactive. Oy vey.

You added more information as I scrolled down and read. It sounds like your doctor used to give you a stand by antibiotic for the UTI when you felt one coming on. That has fallen out of practice because of antibiotic resistance. It's the same thing with child ear infections. There was a time when "prone" children would have stand by antibiotics ready to go when the ear developed. That isn't true anymore either. Overuse of antibiotics has gotten us so we are now getting resistance where there was none before. So they are only being prescribed when definitely needed. Believe it or not 75% of all ear infections are VIRAL. Antibiotics have no effect at all. We do treat anyway because 25% of the time they are bacterial and actually culturing the fluid would be impractical. So we treat. But...in older children that can tell you when they have pain, treating with Tylenol/Motrin and waiting it out a few days to see if it improves on its own is okay to do.
Unfortunately, you need to submit the evidence so to speak, so they know which is the best course of treatment. I can't remember off the top of my head but there is a medication you can get, that you might be able to keep on hand that eliminates the painful symptoms while you wait for the antibiotics to take effect. Just remembered...Pyridium. It's a prescription. Maybe it would be something your doctor could help with.
