Breaking news: Kate drops lawsuit against Jon

Kate stipulates it will be dropped with prejudice. The portion of the suit against Robert Hoffman and the John and Jane Does remains.

JOINT MOTION TO DISMISS WITH PREJUDICE

Plaintiff Kate Gosselin, by and through her attorney, A. Jordan Rushie, and Defendant

Jonathan K. Gosselin, by and through his attorneys, BrittonTuma and Orwig Law Offices, files

this Joint Motion to Dismiss with Prejudice pursuant to Federal Rule of Civil Procedure 41(a)

and (c) and in support thereof, state as follows:

Plaintiff Kate Gosselin agrees to dismiss with prejudice all claims and potential claims

that she has or may have against Defendant Jonathan K. Gosselin that were or could have been

asserted in this case.

By this motion, Plaintiff Kate Gosselin is not dismissing her claims against any

Defendant other than Defendant Jonathan K. Gosselin.

Defendant Jonathan K. Gosselin agrees to dismiss with prejudice all counterclaims or

potential counterclaims that he has or may have against Plaintiff Kate Gosselin that were or

could have been asserted in this case.

Dismissal with prejudice of the claims and/or counterclaims between Plaintiff Kate

Gosselin and Defendant Jonathan K. Gosselin is appropriate pursuant to Federal Rule of Civil

Procedure 41(a) and (c).

I can't even imagine the drama her attorneys went through urging her to drop that. I wonder what changed her mind. Someone else here had it right that dropping this really was her only play. It's not the best outcome because now it just looks like she was just hitting below the belt without any merits and hoping he would cave, but it's better to get out now rather than later. I'm concerned about that, too....that somehow a deal was made to absolve Jon in exchange for a way to beat up someone else.

Kinda like how the TLC deal was made. There was something weird about that, too.

So what does this lead to for Robert? If the claim was they conspired and she dropped claims against Jon, what does that lead to that she thinks Robert did? Stole the harddrives himself ? (Not from the trash because that's not stealing). She still doesn't allege libel does she?

If she dropped all the complaints against Jon, what is left for her to go after Robert and the Does for? The only thing I can think of is Invasion of Privacy. The Civil Conspiracy and Concerted Tortious Action would have to involve finding out and naming who the Does are, wouldn't it? Especially, since Jon would no longer be part of that. You can't have a conspiracy with only one person (Robert) involved, and how would they go about proving it?

What does she have against Hoffman without Jon? If there was a "conspiracy" that they both benefited from financially (according to her), JON was the one who had access, not Hoffman. At the end of the day, it's clear to me this was all a big publicity stunt to publicize her stupid cookbook and delay Hoffman's book for as long as possible. That's it.

She's so done now, it's not even funny. Who would ever hire her again after this stunt?

Look I filed this to try to bully and intimidate Jon in the hopes that he would eventually cave in lose everything and at some point hopefully sign away his parental rights. I did not expect the royal ass kicking that IT IS NOT A TUMA gave me and as a result I ran away like a sobbing little girl who lost her teddy because at the end of the day most bullies are COWARDS. I think that Robert has more than enough evidence against TFMJG without any ''evidence'' from Jon. I think that maybe someone is hoping that somehow WOS will skate through this mess. I think that her biggest mistake is to continue with the lawsuit against Robert, when he has CLEARLY said that he used a tiny bit of the information about her.

I'm actually happy that she refused to drop the lawsuit against Robert. She is once again proving without a doubt how stupid she really is! She will get exactly what she deserves...exposed to everyone!

If the claim remains that he ruined her reputation, will she have to prove that the words published in his book (as taken from the journals) weren't altered in any way? I can't imagine that she would want to go through deposition for that.

I just wanted to point out that the case could have been settled between Kate and Jon. The settlement would not show up in the docket report. There would just be a stipulation to dismiss with prejudice. I have settled many cases and just filed a stipulation to dismiss. However, I did receive compensation with the settlement and the terms are almost always confidential in my cases. There is no way with the docket to know if Kate voluntarily withdrew her case or just settled it and what the terms are.

Any decision reached pre trial is a "settlement" but it doesn't mean either one had to give up anything. It could have been as simple as Kate realizing no one is backing down here like she planned. So her attorneys phone his attorneys and drop it. If it were a formal settlement usually those terms are spelled out and I don't see any terms here. It's just an agreement among all parties to drop it. Again you often don't have to give up a darn thing to get the other side to drop it especially when it's this weak of a suit. It's really their money to spend and that's often all the motivation they need to let it go. Her suit against Robert is going to be even harder. She's a public figure and he is, like it or not, a journalist. So few of those suits ever make it past the front door. The burden is all on her. It's just a money pit now.

Count me out for the conspiracy theory that Jon sold Robert out. Tuma's case was strong and he's apparently a sharp shooter who doesn't need under the table deals.
I believe Tuma just out lawyered Kate. FINALLY!
If Tuma's case was weak, or if he appeared to be a hack, and then suddenly, inexplicably, the case is dropped with prejudice, then I'd smell a rat.
This scenario doesn't ring true to me at this point, after what we've learned.

Put me in the pool that Kate will declare that dropping the lawsuit against Jon is an act of selfless, motherly love, and for the childrens' sakes and theirs alone, she is dropping the suit.
Cue frowny face and shoulder shrug.

Plaintiff had through today the 19th to give her response to defendants' motion to dismiss. Instead we see this Joint Motion to dismiss charges against defendant Jon Gosselin.
I am willing to bet plaintiff will not be filing an answer.
The case should be dismissed.

Looking at all my cases on the docket people would think that all of my cases were dropped by my clients. The truth is every single case was settled with compensation for my client. Hahahahahahaha. More like Kate's attorneys played HER beautifully. I'm sure they did get exactly what they wanted - a boatload of the children's hard-earned cash.

Her attorneys had no other choice but to cut and run after Tuma eviscerated them. They are probably just very relieved that Jon is not
a vindictive ogre and agreed to dismiss any potential counterclaims.

Another reason that I don't buy any conspiracy that Jon bartered who knows what to get Kate to drop the suit is because of Tuma's strategy.
Tuma took a risk with what I've come to think of as a "low percentage play", thanks to what I've gleaned here.
Why do that if you're not confident?
I think Tuma's MTD were more than Hail Mary passes.

I agree. However, she posted that little declaration on her bog that the lawsuit was for the safety of her kids, and then she says that she dropped it for the well-being of her kids? She can't have it both ways.

Wow - very happy to see this! Forgive me for being slow, just needing to understand. The judge didn't throw out the suit. K & J agreed to drop the suit and any countersuits. Either way, the result is the same. It is wonderful that she can't file this nonsense again.
Also, I don't believe for one second that Jon threw Robert under the bus.

First, if he admitted that, no way would TFW drop the suit. 2nd, that would just show that what Robert wrote were TFW's words, and what would that do? unless J admitted they were somehow altered...I think they are reaching.

In a settlement, there are sometimes "gag orders" included with the terms of the settlement, which means that no details of the settlement may be disclosed to anyone, and sometimes these orders are imposed for life.

Oh, good point, the MTD was for the whole lawsuit, not just claims against Jon, correct? So since TFW did NOT file an answer, the suit may be dropped and TFW would have to refile against RH and the Does. Do I have that right?

I join you in that bet. I believe it was only Jon, through his attorney, who filed a motion to dismiss. Hoffman may or may not have joined in that motion. Now, what Hoffman's attorney may be considering is filing his own motion to dismiss. And how nice for him to have a template to use - the very well written motion by Jon's attorney.

I do not believe Jon offered Kate anything - information, money, etc., in return for this dismissal. What is more likely is that her attorneys knew this was a loser, and convinced Kate that it would be a costly loss to her. I am sure they are charging her by the hour. It is possible that each side agreed to pay their own legal fees and costs and simply walk away.

Shawn Tuma and his firm are formidable opponents. I believe Hoffman does have a good law firm working for him, but perhaps not quite as aggressively. Still, I am optimistic that Kate will not prevail against Hoffman either.

A fool and her kids' money are soon parted.

One way to tell if there was a settlement is if you don't hear a word from Kate or Jon. They are allowed to say the case is dismissed or settled, but that is it.

If the case was voluntarily dismissed by Kate then both parties are free to speak about the case.

Wasn't the heart of the suit the allegation that Jon hacked, gave data to Hoffman, who wrote the book (invaded her privacy). And they conspired together. If Jon didn't do anything wrong, then what's left? Hoffman conspired with himself? Hoffman hacked?

If all charges against Jon are dismissed with prejudice, won't K's attorneys have to rewrite complaint to leave out Jon, allege what Hoffman did? Or does Hoffman's lawyer have to rewrite/reinterpret it to leave out Jon before he can refute it? That seems ridiculously unfair.

It does seem without Jon, allegations against Hoffman are extremely weak. Unless allegations formerly made against Jon are now being made against Hoffman?

Kate assumed that Jon and Robert wouldn't have the resources to fight back, and she would win by default. She must have been stunned when Jon lined up Tuma and Tuma proceeded to rip her claims to shreds. It's possible that she decided to cut her losses and run, if Jon would agree not to sue her for filing false charges against him. She won't drop the charges against Robert, though, because that's the only tactic she has left to stall the publication of the book. She knows he is ready to republish at a moment's notice, and she knows that he has an offer to make a TV movie. That would destroy her. She has to hang on and try to figure out a way to stop him, or at least delay the inevitable.
What charges does she have against Robert now that Jon is out of the picture and there was no "conspiracy"? Is she left with that "It's all true but it invades my privacy" claim? HA!
I can't wait to see how the sheeple try to spin this.

I don't know that Kate every truly believe this case would come to fruition. The short play was file the suit and get on many more and bigger shows for the ersatz cookbook tour (that applies to both the cookbook and tour, btw).
Mission accomplished, n'est-ce pas?
The long play may not have been Jon at all. He may have been the red herring or even collateral damage. The long term goal was- is - to stop the re-release of a book that no doubt will damage her reputation profoundly.

There would be an incentive for both parties to settle. Jon because he doesn't want the case to drag on even if he would prevail. Kate because it's a way for her to save face. She can claim the case is settled and everyone will think that Kate prevailed. I've seen plaintiffs settle for absurdly low amounts when their cases fell apart just so they could feel that they "won". If Kate states she dismissed the case then I'm inclined to believe there was no settlement. One way or another her lawyers must have had a terrible night convincing her to drop this suit against Jon.

I almost forgot. I've had cases where the settlement was that the Plaintiff could say absolutely nothing about the case- including the fact that the Plaintiff even sued the Defendant. If I was Jon this is what I would want included in my settlement agreement.

I wonder if Kate delayed dropping the charges until after her H&F taping. Perhaps she didn't want to have to show her face after having to own up to the fact that her lawsuit was all a lie. So, knowing that she would be dropping the lawsuit, she filed for an extension, went on the show to pretend to be the world's most amazing mother (cough, cough), then filed the inevitable paperwork when she got back.

Is it possible that, as part of the agreement to drop the charges, Jon got her to pay all of his legal fees? She drops everything, and he agrees not to sue her when she agrees to pay his lawyer and never file those false charges again. I hope that's what happened. There's no reason he should be made to pay when he didn't do anything wrong.

Yes- he could also have a gag order so Kate couldn't tell anyone anything about the case. Settlement isn't necessarily a bad thing for Jon. This would be a good way to stop Kate once and for all. I've seen cases where the attorneys argue for sanctions against the other party for filing frivolous suits that they couldn't prove. They also request attorney fees. A settlement would end the motion for sanctions.

Wonderful news! But not surprising since we all knew she had no case against Jon. She was just betting on him not having legal representation and folding to her demands.

I hope both Jon and Shawn Tuma read here so they will know that I am congratulating them both! What a great job using the LAW to show Kate Gosselin she has to STOP trying to bully Jon now that she can no longer control him and make him do what she wants.

And to Kate (since we know you read our posts too): You continue to prove, over and over again, how you are a hateful, vengeful, and ugly person. And by filing a meritless lawsuit against Jon, who your children love so much, you just added to the long list that demonstrates just how evil and spiteful you are as a mother.

Though I am so happy for Jon tonight, I am so sad for his kids if they are with Kate now.

Since is has been made very clear that Tuma is an excellent attorney, I suspect Tuma would protect his client, making sure that TFMJG paid the legal fees Jon has accumulated. I don't know if we will ever know the details, but I trust that Tuma got every concession he wanted from TFW and her attorneys!

Yes now there is another stipulation filed (not signed by judge) to give plaintiff through Nov 27th to respond to defendants' motion to dismiss.

In my mind they know this case is done and are attempting to work out something with Hoffman's attorneys.
Guessing there is no response to the previously filed motion to dismiss, my guess is they are attempting to bargain.
Its down to brass tacks, they want the book stopped. But how, and what do they have to offer Hoffman? In that case, with this case stripped bare, what do they have period?

80% or anywhere near 80% is way too much time spent in the kitchen, but I think the kitchen is Kate's refuge in a house full of children. I don't get the sense she cooks with her children, teaching them patiently.
That's her space, not a place for interacting or nurturing.

So happy for Jon. Hope TFMJG/WOS will dismiss the suit against Robert. Although it would be fun to see her try and win in court.

It's very appropriate that this dismissal comes on the McCaughey septuplet's 16th birthday. Makes me hopeful for the Gosselin kids' that their 16th birthdays will be joyous and free of the stress caused by the WOS.

Hopefully, Jon will press his advantage and get more custody time or full custody.

I'm a little surprised that Kate agreed to dismiss WITH prejudice. That means she can't hold the threat of suing him again over his head. We all know that she can't stand to give up control, so it would have taken a lot to get her to agree to that. I wonder what it was? Did her lawyers tell her that the judge would dismiss and Jon could then sue her? Maybe it was an "I won't sue your lying a$$ if you agree that you'll never pull this stunt again" situation? We know Kate doesn't have the kids' best interests in mind, but Jon does, and wanted to put an end to this mess for them.

How hard would it be for Kate's lawyers to talk her into this? She would have fought it tooth and nail. Having to back down to Jon? Having to admit that sometime "no" actually means "no" for her. Having to admit that she's NOT in charge. Her poor lawyer. He deserved it, though, by getting involved in this mess.

And all that time in the kitchen cookin.....I cook every night........yep, every night cooking from scratch for 5+! kids. I work at a hospice-organization, partime, not fulltime....sorry, but I love cooking.... I cook like a good Jewish mom so I always! = always!!!! have way to much, but it does not....DOES NOT.... take that much time to put a good healthy meal on the table in about 30 minutes. I do get out of my kitchen. Oh I don't use paper plates and we only have 1 dish-washer. I always tell the kids..whatever doesn't fit in the dishwasher gets washed by hand....magical words :-)

I believe that Kate dropped this lawsuit because she is a changes person and realizes that because Jon is the father of her children, she must do what is best for the children and never talk bad or disparage their father. She realizes that she must set a good example for her children and if they CHOOSE to VISIT him, she must support that, no matter what questionable "choices" that their father may make. She will continue to do what she must "for the kids" and that includes protecting their privacy. All she does is for the children and she will continue to work hard to polish the gold and silver platters that she alone has provided for her children, because they do DESERVE them as they were born into a family of multiple multiples.

At this point, there are no Jane and John Does, if discovery has brought plaintiffs counsel to their own motion to dismiss against their main defendant, then discovery did not bring about the Does either.

I highly doubt any attorneys are willing to begin a New case against Hoffman and the Does.
I really think the ball is in Hoffman's court and all that remains are phone calls back and forth between the 2 camps.

I wonder if Tuma is advising. I hope so.

I imagine the with prejudice was a real sticking point. It could have been as simple as fighting over attorneys fees and whether that portion of the suit will be dismissed with prejudice. I have a feeling Robert wouldn't be as likely as Jon would be to roll over on attorneys fees. Robert and Jon are in the position to call the shots here and if Robert says fine don't wanna pay my fees than you'll just have to go forward with this, Kate could be stuck. What a mess she got herself into. Karma sure is painful sometimes.

Robert 'wrote' the book for the children, has MUCH more information, has refused to back down, and I will NEVER believe that Robert will ever ever ever back down from TFMJG.

Carol, I agree that we cannot know the terms of any settlement worked out between Jon and Kate in this lawsuit. However, I have seen more than one case come through our office where after discovery was conducted that showed plaintiff had an extremely weak case, that settlement was simply an agreement to dismiss the case as long as the defendant did not seek costs of suit. So it does happen, and it could have happened here. The reason I think it's more than 40% likely, is because we've read the complaint, Tuma's motion to dismiss, and the amended complaint, and further motion to dismiss.

Plaintiff's side did sloppy work, had weak arguments, and a poorly crafted complaint. Defendant's side had an extremely strong response, point by point refuting the allegations of the complaint. If the motion had been heard, I'm fairly confident it would have been granted in large part.

So plaintiff is coming from a defensive position, not a position of strength. Defense has the upper hand, from what is publicly available. I could quite easily see Tuma saying, "If your client will agree to dismiss my client with prejudice, I can probably talk him into agreeing to drop his counter suit and further, not seeking his costs of suit."

But again, you are correct in that this is not put on the record, is usually confidential, and so we'll never know for sure. But Tuma is a bulldog and I can see this scenario play out.

I agree, it happens all the time. People can agree to just drop things without any money changing hands. You don't get to file a lawsuit and then just get bought off every time. Plus at least in my experience a judge has to approve all settlements and if something smells fishy they will say nope not doing that. Making JON pay in this whole mess seems borderline blackmail. Any good judge reading these briefs would be suspicious of a payout and rightly so. Why should Jon pay KATE when his briefs demolished hers? As in I'll make your life miserable and sue you into the ground until you pay up. I would be careful about going there if I were her. A judge could get suspicious especially given how baseless this suit is.

Like I said, she made the only play she had left. The only play any attorney would advise her to take. She had no choice here. She had to get out of this ASAP. And I think the same will happen for Robert, as that's her only play in that situation too. I think the only fight here is over attorney fees. Besides I doubt neither Jon nor Robert has much money even if she did demand a payout. And based on how we were just discussing that her Home and Family interview was one of her most VICIOUS yet against Jon, I think we know exactly how she feels about this situation. She's not happy.

Hm, interesting strategy there. Can't say as I've ever seen an attorney TRY to lose then claim that was a victory lol.

Basically what they are saying is if Kate played this "beautifully" but the lawsuit ends up flushed down the drain, that Kate was just being manipulative and playing games. Being manipulative and playing games, especially as a 37 year old MOTHER, is really not something to admire, sheeple. Good grief, grow up.

Carol, I agree that we cannot know the terms of any settlement worked out between Jon and Kate in this lawsuit. I agree. Thank you for clarifying. I just meant to say that looking at my cases you would think my clients all dismissed their cases and that wasn't the case. I didn't mean that Kate was compensated for any settlement. In fact, Kate could have very well have ended up with nothing.

The only reason I think there was a settlement possibility is that Kate dismissed the case with prejudice. I have dismissed cases for my clients for various reasons, but would be reluctant to dismiss a case with prejudice without a settlement agreement. The reason is what if a reluctant witness suddenly came forth next week or new evidence was discovered? Kate would be fuming that her attorneys suggested she file the dismissal with prejudice.

Again, as pointed out by Millicent said it doesn't mean that Kate received any type of compensation even if she had a settlement agreement.

I also think that Kate's attorneys probably tried to get her to dismiss her case against Robert, but she refused to budge. She knows that Robert will publish his book the second the lawsuit is over. Kate's attorneys probably asked for the extension of time to try to talk some sense into Kate and work out the details of attorney fees as admin said. What's really ironic is that no one would have noticed the re-release of the book if she hadn't brought so much attention to it through the lawsuit.

Seriously scolding her. Nothing new to those of us who've been watching her unravel for a long while now, but the timing of his reappearance is very interesting.

Admin I think you're right, it was all or nothing for Tuma. And partly because this was truly a frivolous lawsuit.The initial complaint was vague and pieced together.
As someone said awhile back, it read like Rainman's notebook; "Charlie Babbit squeezed and pulled and hurt my neck in 1988."

What is unknown at this time is whether Jon has agreed to testify against Robert in exchange for Kate dropping the case against him . . . or not. It would seem a logical move and while I “suspect” that is what has happened I do not know and that is unconfirmed at this time. At this point anything and I mean ANYTHING about the reasons she dropped her case against Jon is nothing more than pure speculation by anyone, myself included. She does not automatically owe Jon for his attorney fees, he must sue to recover them but that will depend on what kind of agreement the two have struck. However, I see the #nutterbutters have (as predicted) decided to ignore the old adage “best to keep your mouth shut rather than open it and remove all doubt.” And, as per usual, they prove that basic legal knowledge and fact checking is beyond their mediocre and extremely limited intellectual capacity.

Tuckersmom: Jon was freelancing, running his own business in IT work. He did contract work. That is where the sheeple get confused, in why Jon had so many jobs over the last 4 years, they were contract work, which for people who don't understand what that is: he works for a predetermine time period, anywhere from a month to a couple of years. When contract is over, he finds new clients. Jon said he was running his own business.

What lawsuit?

He disappeared when he was outed by a fan who allegedly accessed his personal information illegally and he had to cancel his credit cards/bank account etc., and has been silent, saying it's in the hands of proper authorities. I doubt if it had anything to do with BV and the class action suit.

Woo Hoo! New post and WHAT a post! No way in the world do I believe any money went to TFMJG. More likely she was finally convinced by attorneys of futility of her complaint. And by the way, razzle dazzle does not appear anywhere on the motion, correct? Just the local guy who didn't know which court house to go to.
