All I can say is wow.

1.I hope this is fake.
2.If it's not fake I feel so sad for the kids.
3. I don't see the point in this we haven't heard from Robert in how long?

TLC stinks said...

Stay tuned. ROL will be all over this. She just wants to bankrupt Jon and Robert with attorney fees.

Realitytvkids.com ~ Administrator said...

Her children go to Jon's correct? Presumably they eat there and sleep on beds and have toys. Does she want to bankrupt him for every last cent or would she like him to have a little pocket money so her own flesh and blood children can be comfortable and happy during their time with him?

Obsessed parental alienation.

Truther said...

Wiretapping? she's accusing Jon and Robert of wiretapping? WTH. This proves she will do anything to stay relevant, inspite of her children. What are they, collateral damage? She is despicable.

TLC stinks said...

I hope Robert has been telling the truth. He and Jon should file a counter lawsuit against her if that 's the case. I bet she has threatened them, through her attorneys, for months leading up to the filing.

Terri said...

If this case makes it to a court room I'll be surprised. I feel that it will be thrown out. Even if it doesn't I can only imagine the amount of dirty little secrets that will be exposed. All those confidentiality agreements go right out the window. Many people that Kate doesn't want to talk will be called into court to testify. She may come to regret this last little stunt of hers. As far as those poor kids are concerned, I can't even imagine the hell they are going to have to live through knowing that your mom is suing your dad. This woman is despicable beyond words.

TLC stinks said...

Robert has thankfully probably been told by his attorney to keep his trap shut. Kate and BV, working with ROL, are the ones who have released all kinds of info publicly.

TLC stinks said...

INTERESTING TIMING with the cookbook about to release. She is betting on getting more tv air time.

Over In Kate's County said...

Reposting this because I don't know where it went!

Those poor kids, and with school starting on Wednesday. They will hear about this in school. Great welcoming back to another school year. Taunting..."Your dad's going to jail."

Is prelimary statement the same thing as preliminary statement? Geez...

How can you sue 20 people if you don't know their names and addresses? Depositions should be interesting.

#35 "Untrue" -- will she have to prove which part of the book is true and which part is untrue?

You know...Robert's book was all but forgotten. Why in heaven's name would she drag this up again? Publicity, vengeance, greed, or all three? Sometimes you just have to let sleeping dogs lie, and for the sake of the kids, this is one of those times.

Realitytvkids.com ~ Administrator said...

Wiretapping lol. This would be funny if there weren't kids involved.

Why do I picture Jon and Robert dressed up like Nicky Cohen in hats and oversized ties going into her TV installing wires and gluing microphones behind the wallpaper.

Seriously Kate? Get a grip here.

TLC stinks said...

So how does this work, Admin. She files a lawsuit, Jon and Robert's attorneys respond and then does a judge rule there is enough to go to trial?

I see why she wants to keep the kids off the internet.

She knows good and well if her kids saw this that they would hate her.

wonder if Jon "flips-out" and releases his book September 24 and the sales top Kate's by millions.

If this lawsuit goes forward; wonder what the kids will say or do?

She is Evil said...

Kate "I just want peace for my kids" Gosselin is destroying her kids.

She signed, under penalty of perjury, a complaint that states Robert claims to have 5,000 family photos and that's impossible because there weren't 5,000 paper copies of family photos in the garbage. We all know that Robert claimed to have computer disks, not paper photos. Did she even read the complaint before she signed it?

Jon Fan said...

Jon said in an interview that he is deeply in debt. All this will do is make the debt worse triggering a bankruptcy. He'll end up better off than he is right now.

Anonymous said...

More outrageous behavior on the part of TFW towards the father of her children. Isn't this the first day of school for them? The children will be exposed to all sorts of comments/abuse when this news gets out. In the recent People article she is quoted as saying she has changed. No, she is impossible of change. The timing of this news is highly suspect; coming as it does on the eve of her book/tour/campaign.
She is hoping for sympathy interviews where she will be able to sob, "I can't talk about it, it's before the court". Next she will be suing her own children after they write their "tell alls".

bm

Let's throw tomatoes said...

Wow! I'm suspicious of the timing. When Robert's book was coming out Bully came out of nowhere and put a big red stop sign on it.
When Kate's cookbook is coming out and it's already dead in the water, BAMM, lawsuit. Maybe Kate is hoping that this lawsuit will get her on those talk shows that were not returning her phone calls.
My bet is that's its going to backfire and her hater( dislike her) group is going to grow!

Auntie Anne hope your hubby is doing better. He is very lucky to have you to care for him!

Zoe, hope you stay and comment, you have a friend in me!

WhatThe? said...

RWA wasn't lying. She knew before this happened. I wouldn't want to be caught up in this type thing either.

Over In Kate's County said...

This could come back to bite her in the butt...big time, if she has to prove all points in the complaint, particularly the "untrue" part. In deposition, she could be asked, "Is it true that those were your words...that you slammed your child down in the crib so hard...afraid you were seriously could to hurt them?" and her answer is "yes, those were my words."

If, as Kate has always said, everything she does is for her children, then how on God's green earth is this going to help her kids?

NJGal51 said...

And she thinks this will help her sell books?

Truther said...

Ahaaaa Kate is asking for a Jury trial. Is that usual in a civil action Admin?

Jon Fan said...

Admin, shouldn't hacking and wiretapping have been settled in criminal court first? Doesn't the fact that there were no criminal charges filed against Jon & Robert speak to the fact that there's no there there?

Not Lies said...

All the reports say that it was personal and confidential information but nowhere does any report say that it was lies. She is a piece of work. If true, won't everything in the book come to light? I don't see how this will be good for her or boost her careere UNLESS she's doing it to get sole custody and move the kids to CA.

Smoochie said...

LOL ROL has the story and I read some of the comments. 2 trying to defend her, but some real scathing comments about Kate, her motives and what this could do to her children. In fact a few have pointed out the obvious, not only will what she did come to light, now it will be exposed to a much larger audience than the book ever could have reached.

It's all about money and destroying Jon or it wouldn't have been a civil suit for money, she would have turned any evidence of this over to the police, for official charges for theft, illegal wiretapping and the like. She really is a piece of work and I don't mean that in a good way!

So Milo thinks it's wonderful that the kids will be scared out of their minds that their father, whom they love, might be going to jail? Right on, Milo...you rock.

Who are these twenty unknown people? Is this like the unknown comic, with bags over their heads?

Isn't Kate allegedly up to her eyeballs in questionable activities, conferring with teens in taking down the haters? I can't keep up with this stuff.

OrangeCrusher1 said...

This is sickening. Hi kids - after a long boring summer, mommy decides to file a lawsuit against daddy just in time for your return to school. Oh I'm sure none of your friends, their parents or teachers will have seen this.

What a delusional d-bag. Perhaps some of her book tour 'interviewers' will have the cojones to ask her about this instead, so much more interesting than canned food recipes. What is she thinking?

She needs to be taken to court for parental alienation.

Millicent said...

I am going to offer my nitpick regarding this lawsuit filed on behalf of TFW. I looked at the document posted by ROL, which appears to be a file-stamped copy of the Complaint. In the heading, it lists "Kate Gosselin" as the plaintiff. However, in the very first paragraph of the Complaint, where the parties are identified, it reads:

"Plaintiff, Katie I. Gosselin ("Kate" or "Kate Gosselin") ..." That means, they should have listed her as Katie I. Gosselin in the heading, not "Kate."

As I said, it's a nit pick, but shows sloppiness on the part of her attorneys. If this had been attempted to be filed in our local courthouse, the clerk would have pointed out the problem and would not have accepted the complaint for filing as is.

My other question was regarding the statute. When did Kate first know about this alleged hacking, and did she file her suit in time. Of course, they did cover that in the complaint, although I don't think they give any exact date as to when this hacking was allegedly discovered. They say "recently."

Okay, I said if and when a lawsuit was filed, there would be easily accessible evidence of it. This appears to be the lawsuit. Kate didn't "join" in any lawsuit, as she is the one who initiated this one. I am not familiar with computer law, hacking laws, etc.

All I know is that Robert has claimed that he found documents and either a hard drive, a computer, or computer disks in the garbage that was considered accessible to the general public. He has always claimed that he violated no laws, nor hacked into Kate's computer, e-mail, or phone.

As to Jon, who can know what a spouse (and soon to be ex-spouse) might do? It's a rather common occurrence that when a couple fights or breaks up, one will access the other's e-mail, phone records, etc., to snoop around for evidence of cheating or other information. In fact, some of us have admitted that we've accessed our minor child's Facebook page, or Twitter account, or cell phone records. Is that hacking?

I could certainly see Jon knowing (or figuring out) Kate's passwords. He might have read her e-mail to see if she and Skeevy were having an affair, as he suspected. He might have felt she was hiding money from him to avoid an equal distribution of funds during the divorce.

But on to my real question. What is the requirement in Federal Court for proof of damages? If they are able to convince a jury that Jon or Robert accessed information, had an e-book briefly published (for 2 days) on Amazon, what then? Kate's reputation was pretty much the same before and after the publication. Is she going to try to claim that she has lost work because of the two-day publication of Hoffman's book? How will she prove that? Did she have a contract in the works, that was then cancelled upon publication?

What are her damages exactly?

No matter what, as you point out Admin, this will be costly for Jon. He now has to retain an attorney admitted to practice in Federal Court, pay him a large retainer, pay filing fees, and who knows what else. I hope he gets good legal representation and I hope he prevails, and wouldn't it be wonderful if he got attorneys' fees and costs. Only time will tell.

When karma catches up with Kate, it will be a doozy.

The complaint states that all parties reside in Eastern Pennsylvania and that John and Jane Does were involved in hacking and wiretapping. This has nothing to do with Twitter haters.

Lawyers use the John and Jane Does to include anyone whose name comes up in Discovery. There aren't 20 more people being sued. It's a lawyers way of covering all their bases.

Terri said...

My post never went through earlier, but I had mentioned that if this suit does go through (which I think it will be dismissed) I believe that all of those confidentiality agreements go out the window. I thought that when it came to a court case those can't be enforced. Please admin. tell me if I am correct.

Millicent said...

Melissa NV said:

******

That's something standard used when filing a complaint. You name "Doe defendants," so that if you discover the identities of other people you want to bring into the action later, you can do so. You file an Amendment that names the person in place of, for example, "Doe 1." The fact they only included up to 20 possible doe defendants means they don't think they will be naming numerous other parties to this action.

Summer Days and Nights said:

******
You are right - it has nothing to do with BV, except that BV's attorney is listed as co-counsel for Kate, pending approval of pro hac vice status. Apparently, Radazza is not admitted to practice law before this court, but will apply for special permission to do so, just for this case. His request will probably be granted. Radazza and his firm are the attorneys who represented BV's owner in some past lawsuits. So there's the connection, but you are right - this is not a class action suit, and I cannot see where the information given by RWA's owner in response to some monkey'd up subpoena would apply here.

I'm sure Goody is doing the happy dance. As for RWA, giving out info, most of the info on people, were given to BV by the Kate lackeys, that stuff had been out there, and hacked etc. If any info, it's like Admin said, last thread, they have no IP info, just set up info for web-site. Most of the info they got was wrong.

PA is not a community property state, but assets held by both parties are subject to equal distribution when divorced. It's marital property and tends to be confusing.

Very telling that the Complaint doesn't allege slander or libel. All of the counts have to do with how the information was obtained, and no claims that the contents of the materials or the book are false.

She is so predictable. Sadly the children will again be the ones to lose the most.

fidosmommy said...

Does she honestly believe that Robert's book was her downfall? Seriously? Has she checked
out her bio BEFORE Robert put out his book?

I guess if you can't make money by writing a cookbook or a memoir to your kids, or by getting another TV show or selling Bella Bars or by running marathons or by being an ET correspondent or by blogging or by couponing or by getting a seat on The View... then just sue someone! That'll fill the coffers just fine. Summer vacation, here we come!

I've been wrong before but I just don't see that this lawsuit will go much of anywhere. I feel confident Robert will stand by his story of getting the discs out of the trash. I also believe that this jury on demand will see that it makes sense in light of Jon's moving out and TFW's determination to get everything connected with him off the property NOW.

I have been a plaintiff in a civil suit. I won, but it still cost me about $25,000 in atty fees. I hope Kate is aware that it's possible she will not win and she will lose money in the venture (unless it's a case of "you don't pay unless you win")

I continue to be astounded by her.

The logic in number 30 is so ridiculous I can't believe an attorney wrote it.

Picking through trash is not illegal, you could certainly have found many paper documents if there were a lot of bags of trash out there (no one ever specified whether it was 2 bags or 25 did they?) and you could find even more if they were electronic. I can hold 5000 photos in one hand. It's called a 64 gig memory card.

I think TFW should just be honest with what she wants: Jon gone, for good, out of the children's lives. Just own it.

Why do the attorneys say with the accusations " by information and belief"? How can belief be proof?

TFW, CVW (current vindictive witch), knows she'll never collect any money from Jon, so she's going to try to prevent him from ever being able to earn any money in the future. She's so vindictive she'll try to attach all of his future earnings beyond what's necessary to pay his bills and leave him unable to even treat the kids to an ice cream cone!

I've never doubted it, but if anyone ever did I hope this suit proves that she hates Jon more than she loves her children.

You can have external HDs or even spare internal HDs. It doesn't necessarily mean they took the HD out of the PC ;) Also, Jon should really seek the help of that attorney who was friends with his dad. He seemed to be the only competent one of the bunch, and my impression was that he was helping as a favor, not so much for the fee?

Gayle said...

Personal on line bank accounts seems to be a theme throughout the document. Was she hiding money as many suspected? Does she not realize that everything will come out during a trial and no one will fall for the no tear crying? This may end up as her biggest fail yet. She truly does hate Jon more than she loves her kids. As others have mentioned I think she wants to pick up and move to LA for Mady's career (her own is dead in the water). I guess she doesn't realize that she won't be able to live as she's living now out in CA. She may have f-you money in PA but it takes a lot more in CA. I was think the same thing. But now she'll blame this for her books not selling.

Realitytvkids.com ~ Administrator said...

I think she really is unable to understand that for many people it's more outrageous to sue your children's father than the original crime, if there was one. It's like in her head she thinks see if I just prove to them he stole it, they'll understand.

Kate? It's a hard drive. He didn't choke a puppy or tie you to a tree and leave you there or take your car and push it off a cliff. You're claiming he took...a.... hard drive. A hard drive! She really is clueless how ridiculous, vindictive and vengeful she sounds. Her behavior is far more disturbing than the dang hard drive incident.

Melissa NV said...

I have been a plaintiff in a civil suit. I won, but it still cost me about $25,000 in atty fees. I hope Kate is aware that it's possible she will not win and she will lose money in the venture (unless it's a case of "you don't pay unless you win")

&&&&&&&&&&&

Personal injury cases work like that. Of course, they could have taken it on a contingency basis -- they'll get a third of the settlement if there is one. However, even with that, there are fees not covered and she'll have to fork over some cash.

Melissa NV said...

Kate? It's a hard drive.

&&&&&&

Is it a hard drive, or a disk? The complaint alleges hard drive; Hoffman says disk, not hard drive.
I guess we'll find out!

Kate's need to stay relevant is really going to back fire. All of the stuff she said in People>she just contradicted herself(not that anyone really believed her). Will see if any of the media will do a interview, other than the Today and that Canada show, and those were for the cookbook promo. Course, Kate will say, her lawyer said, not to talk about it. What a piece of work. And the comments at some of the articles> most if not all are negative. Good job Kate!

But there are no claims/legal theories based on falsehood. No slander or libel, for example.

There wouldn't be in the complaint. However, they are alleging "untrue" and if this is included in the recitation as part of the suit, it will have to be proven, or thrown out.

Kate said in May that she was going forth with a lawsuit after all the BV craploa. I would say, in my limited experience, that filing of her lawsuit was no surprise to Jon nor Robert. The attorneys on both sides are in contact and even may share the filing beforehand to intimidate the defendants. It's like, see what we are going to file and it's going public, so you better cave and nice. They did not. I think Jon and Robert will be just fine. From what I read of the lawsuit, it sounds like a bunch of suspicions and not facts. Why file in civil court if what you claim violated federal law and was criminal? I think because her evidence is not solid.

Unknown said...

I've just started reading this new topic, so I'm sure that what I have to say has already been said, but I want to get in my two cents and questions right now...lol

Robert made it very clear that he has PROOF of everything he found in the trash. He said he had it in a safe place. Robert also said/warned TFW that if he was called a liar by TFMJG, he would release even more damning information.

Now that TFMJG has sued both Jon and Robert, won't everything he has now be a part of discovery?

I don't understand why the law suit continues to say the ''hard drive'' was stolen, when Robert has said over and over and over that he found disks, NOT a hard drive.

Why is the suit saying that things in the trash were stolen? Doesn't the law firm that is filing the suit know that in PA, once the trash is at the curb it is no longer the property of the person putting out the trash?

That woman is a worthless piece of work! I feel so sorry for Jon's children.

The complaint uses wording "untrue" but if she was seeing for slander and /or libel it would say that I would think?

It would be worth it to get her on a witness stand to catch her lying.

I doubt Jon has the money to fight this and this is EXACTLY what the lawsuit is all about: forcing a settlement. Then she can get full custody and stop Robert too.
__________________________________________

I thought the exact same thing. This suit has more to do with alleged hacking than alleged untruths. As I read through the docs, all I could vision in my head was a venomous spider. She is full of venom, hate and rage. I hope someone informed her that Robert and Jon will have their day in court too, and they will be allowed to defend themselves. I think she thinks she gets to present her side, then the judge will find them guilty and banish them to the dungeon. She's taking a huge gamble here. I predict there will be much sniffing and dabbing on her talk show circuit.

Poor Kate, the victim of Jon Gosselin once again. Only this time no one will buy it. 3,000 negative comments on one article about her new life pretty much sums it up.

What's even more mind boggling is that she thinks somehow that stealing a piece of property trumps her physical abuse of her children. Will that necessarily end up being addressed in court?

Suzee said...

I'm wondering if Jon has the money to even hire an attorney, let alone pay the exorbitant fees fighting something like this will cost. TFW doesn't care - she has plenty of money at her disposal plus, most likely, Randazza and friends is giving her a huge discount just to be able to chalk this up as a win for his buddy BV.

Realitytvkids.com ~ Administrator said...

It would be cheaper for Jon to just pay the 5 grand in damages she wants. Sure he could get an attorney and scrape together every last cent that should have been used to provide for his children. But what about the next time she sues and the next? She will never stop. The only way to stop her is for the other party not to engage. She needs therapy not lawyers.

I've said this before, lawsuits don't make it better. While sometimes they are necessary, usually they just add to your problems. Is she looking for that "feeling" she will get when Jon is finally buried? Is that what she wants? Does she know that for most people they report that feeling wasn't as good as they thought it was and that it doesn't change what happened? She sure needs help.

So, from what we know (and Hoffman has always, consistently said) is that he helped Jon move out, and TFW called the cops (and there is a police report to back that up). Hoffman showed up on the next trash day, knowing that TFW is vindictive and would throw out anything else lying around that might be Jon's. He found the discs, and used the information to write the book.
No theft. No wiretapping. No vast conspiracy.
Isn't the burden of proof on TFW? If all this happened just as Hoffman said, then how is she going to prove that it happened otherwise? I'm sure Hoffman can produce the discs that he found in the trash. So, how is she thinking she'll convince people that he never found them if he has them? The complaint makes it sound like Hoffman found thousands of documents and pictures in the trash, and that wouldn't be possible. Hoffman never said any such thing. If a jury can see the actual discs, then they are not going to believe that those discs in their hands aren't real. She has gone way too far this time. And it's the kids who will pay the price. Could it be that this is all just a charade to get the kids from Jon so she can move to LA and re-start (HA!) her media career (double HA!), or maybe get Mady working to support her?

If she thinks one of her children has a chance in Hollywood, she is crazy. They would have had to have been extensively schooled in music, singing, dancing, manners, public speaking, whatever. Apparently none of them had this training or she would have bragged her head off about it. And if she thinks it is cheap living in Los Angeles, she is further crazy.

She still blames Jon for the cancellation of the show. It was bound to end any way, and not in 18 years.

Maybe when the younger kids graduate high school Jon will finally be free of all her threats. I feel bad that he and the kids are tied to her for life. But at least at 18 they will have a choice. Maybe some of them will leave and never look back. I wonder if Robert will let all the dogs out now that he is being sued. She must think she is Teflon. Even Teflon wears out.

Didn't Kate's old lawyers, Laverne & Shirley throughly vet this book over the summer of 2012? Robert had lawyers too. The book was released. It was only for 2 days, then it was taken down by TLC because of their intellectual propery being divulged. Intellectual property Kate surely by contract with TLC, was obligated to protect. Could TLC be suing Kate and Kate is attempting with *this* suit to prove that she reasonably protected it? Hmmmm.

The docs keep saying the book was taken down because the info was illegally obtained. But, but, but... if the info was (allegedly) illegally obtained, how come Laverne & Shirley weren't able to prevent it's release in the first place?

Yes, Jon was living above the garage. TFW gave Jon little time to remove his things from the apartment, so he called Robert to help him. It was raining that night. TFW knew Robert was a friend of Jon's but TFW called the police to have Robert removed from the property anyway. Everything that wasn't taken that night was put out for the trash.

Personal Opinion, I think she is down to just a couple of million left in the bank. To TFW that is "her" money, not the kids. She doesn't feel that she should have to spend "her" money to raise them. It is all Jon's fault that "her" children can no longer provide for "her" lifestyle, therefore, he must be punished. I think that she is starting to panic because from day one everything has been paid for them. She will do whatever necessary to make sure that "her" money stays "her" money.

You're right. It's like emotional blackmail. It's never going to end. Each time she feels like she's been harmed or damaged in any way or needs money or publicity, she'll find some reason to do so.

Of course, any settlement terms could include the stipulation that she could never sue him again. I would hope that his attorney would make certain that this is in place, as well as the terms of the settlement could never to disclosed to anyone at any time.

You know the kids are aware of this and have to have read his tweets. Kate has aligned herself with a scummy attorney and a bully web owner so she can suck Jon dry. He's admitted to having no money so I have to assume she wants to settle this and the settlement will be for RH to turn over all his documents and files and promise never to speak of her again. She's running scared, she knows RH has the goods.

In the complain, #51, it says, "Plaintiff has no adequate remedy of law for Defendants' continued violation of the CFAA and thus requires the imposition of both an award for damages and injunctive relief".
If Jon and Hoffman, as she alleged, did/continue to violate the CFAA, then how can she claim that there is no adequate remedy of law? If they broke the law, wouldn't they have been investigated and charged with a crime? The only way that I can think of that they would not have been charged with a crime is if A) It never happened,or B) she can't prove it. If she is claiming CFAA violations, then it is a matter for criminal court, not civil court.

Layla, you are absolutely right. Below is the excerpt from Robert's blog explaining how he came to obtain the discs. Before Radar would report on any part of his book, they made Robert take a lie detector test regarding how he obtained the information. Robert said he passed with flying colors. While lie detector tests are not admissible in court, they are awful hard to fake/beat.

"Interestingly enough, there’s a police report on file documenting the fact that Kate called the police on me because I was at the house at night in the rain on April 28, 2010 helping Jon move his belongings out of the apartment above the garage because Kate told him that anything that was left would be thrown in the trash the following day. She was so spiteful and mean-spirited that she called the police on someone helping Jon move things out of the garage, in the rain. The report also states that she knew I was a reporter, and yet she still threw his things to the street. Of course I was back at the house before the next trash pickup and picked up what was left on the street for the trash men. Completely legal."

After a little digging around, sure enough I found pictures of Jon moving into his Reading apartment, April 28, 2010

From Huff Post:

"Jon violated a federal anti-hacking statute in order to publish salacious, scandalous and defamatory information about Kate," said her lawyer A. Jordan Rushie. "It's damaged her reputation."

Um, In order for it to be damaged, I kind of think you have to have a good reputation (to being with) in order for it to be damaged!
******
Kate's success, when she had it, was based on being a vaunted Christian mother of HOM's. That myth was shattered to pieces when her own words were published. She beat her kids, for crying out loud.
But, Jon had nothing to do with Kate dressing like a prostitute and acting like a diva.
I too believe this is going to end badly for Kate. If I were Jon, I'd demand that every bit of TLC's raw footage to released and that people who know Kate have their CA's revoked in order to testify.
She is going to try to hurt a lot of people and blame them for her failures, but it's going to work both ways and more people than ever will be reading her journals.

So this piecing and patching she's been doing (People article) was all in preparation for this lawsuit...she knew she needed attorney's fees, so she's been scrimping and saving and slicing her own deli meat?

I wonder if Robert is holding back on some of the ammunition he has against Kate. If I were Kate, I wouldn't feel so smug about all of this. It could backfire and all hell will break loose. Robert doesn't seem like the type of person who is going to take this lying down. I would have thought twice, or three times about going forward with this. Sometimes it's best not to poke the bear.

I think Kate is exposing herself to a potential lawsuit and IRS audit once her journals become a part of this trial.

This whole publicity stunt on TFW's part is backfiring BADLY. Not only do most of the articles show really horrendous photos of her and are not favorable in their report, but they don't even mention her new book coming out. Instead they mention RH's book. And the comments are 'scathingly' against her.
Hey TFW...would you like a little water for that 'burn'?

Fortunately, I was never a child of divorce, but I understand the effects can be long lasting. I can't begin to imagine what Kate is going to put those kids through. What they've had to endure has been awful.
The public and very acrimonious divorce of their parents WHILE FILMING, then the constant poo flinging from both parents on every trash show out there, magazine stories authorized and not and now this.

I don't understand this at all. She claims to have money troubles but she has money for lawyers. Even if she wins against Jon she can't get $5000 or $5 million if he doesn't have it. He can be forced to pay a monthly amount but it won't possibly solve her troubles.

It's really amazing how her hatred of him supercedes everything in her life including any love she might have for her kids.

For those talking about jail time, it's a civil suit. You can't go to jail for a civil suit.

Auntieann> That is puzzling, how did BV get those texts. Are they not private too, if Kate gave them too BV, then she did the same thing, she is accusing Jon & Robert of doing. Where did she or BV get the texts from? Another thing, where did she get that pic of Jon wearing the Asian outfit, when she said that pic of her doing the Asian eyes was stolen and Jon pic was part of that pic set. If all of this is on that hard drive(which I think is more of on a disc), then Kate still has her hard drive, and all the info on it. Robert has the disc. This does not sound right.

I am sure if he did figure out her password it was quite easy for him. I really feel like Robert is telling the truth on how he obtained the disk. Remember on the show she threw out sentimental things from Jon's dad and stuff the kids made and didn't bat an eye. I would imagine she sent the not a housekeeper up to the apt and instructed her to bag everything that was left and throw it out. Typical Kate!

Well, the timing is interesting. This comes out a week after being portrayed as the perfect mom struggling to raise 8 (yes, count them EIGHT!) kids and but still have fun, fun, shrieking with delight, the kids never want to leave the compound. Someone on ROL brought up the fact that Jon was rumored to be on DWTS. While I don’t think that is true, just imagine if he was one of the contestants. What better way to assassinate his character than file a lawsuit a week before announcing the new contestants.

I think Kate took advantage of the court of public opinion one too many times.

Let's face it, she and TLC did a pretty good job of convincing us that Jon was a bum and deadbeat dad. Many people bought into it. Fair enough. But that was 2008. We're in 2013 now, and he really hasn't done much to warrant such continued treatment. He's kept a steady girlfriend, won more custody, and for the most part stayed quiet and his latest interview made him look, overall, quite stable and focused on priorities. She wanted us to kick a dog when he's down, and people weren't okay with that.

The comments on the People article show that the general public is sick of her. She asked for our good graces one too many times. She took advantage of our willingness to take her side one too many times. She also cried poor too many times and won't get a real job, and in this economy, that doesn't sit well with people.

The thing is, the public WILL form a lynch mob if they feel it's warranted. BUT, they will take BACK that lynch mob just as fast if they suddenly decide it's gone too far. Kate's problem is she thought the lynch mob, the pitch forks and torches, would always be there for her as she went after Jon. Only, we've put that all away now and moved on. And now it's turned on HER. She looks like the nut here, not anyone else. The court of public opinion may be nasty at times, but they are often right on the money too.

She misread this situation to an embarrassing degree. Nobody hates Jon anymore except a few fans. If he "stole" a hard drive, or discs, or what have you, the time to address it was when it happened, privately. Waiting just weeks until a book is about to come out makes it look like a shameful publicity stunt.

It took the public a LONG time, too long, but they wised up, and no one is buying her snake oil anymore. It's finally happened. Karma is finally here. This has backfired and will continue to backfire, and the only thing she will be left with on her deathbed is estranged children. Perhaps many of us won't even be around to see that day, and no matter, because that will be Kate's problem.

I just feel really, really sorry for these kids. It's not fair to have to deal with a mother like this. And it won't end once they're adults either. This is a lifelong problem they will have, whether they choose to cut her off or not.

This is a publicity stunt.
I just can't see Jon spurning Kate's offer to mediate things and patch things up between them.
I don't think she'll stop until she ruins him. He hasn't really said anything about her in public in years, so why try to drag him down now and why no prior arrests if indeed he broke so many laws?
I hope that there's at least a chance a judge throws this out.
Some of what her lawyer alleges in the complaint sounds just juvenile and contrived without logic.
It's a real shotgun approached, that's for sure.
She's hoping something, anything will stick.

Lets hope the Court dismisses her case as frivolous claims without proof and makes her pay damages to Jon and Robert. Enough is enough! I do think someone was right when they said she is probably trying to alienate Jon from his children and the only way to do it is to have him jailed. This way she can head out to California and become Kendras next door neighbor. Her actions make me sick to my stomach.
Admin said: It would be cheaper for Jon to just pay the 5 grand in damages she wants.

She sure needs help."

You Are so Right and you can read her like a book.

Realitytvkids.com ~ Administrator said...

You know what I keep thinking. She needs to get a job. Just get a job.

If she had a job, especially a new job, she'll find herself so busy and tired between that and the kids she wouldn't have time to worry herself over all this stuff. She could focus less on her obsessive need to get even with Jon, and more on positive things like work and kids. I think she would be a lot healthier mentally. Some people do fine not working. She is not one of them. She needs to be kept busy. She is truly the epitome of idle hands are the devil's workshop.

Look, in life, sometimes we are wronged. I can think of half a dozen things that have happened to me I COULD have sued for but never did. It's not worth my time, energy, worry and certainty not my hard earned money. Forgive and forget is just easier.

I am in no way saying people shouldn't sue if they are legitimately wronged. Absolutely, go for it. But any good attorney will always advise you to do some real soul searching first and really ask yourself if you want to put yourself through this and what you want out of it. If what you want out of it is to just prove a point you may end up very dissatisfied, and surely out of a lot of cash. Our American court system is not like T.V. Cases aren't wrapped up in an hour and on T.V. no one mentions their $550 an hour fees. Lawyers are magically paid and cases magically move in and out and justice is magically done. Not the real world.

If we went around suing every single time the opportunity was there we'd all go broke. Perhaps she was "wronged" with these discs or whatever it was. But you can go around trying to exact revenge and even the score against every single thing or you will go crazy. Is THIS incident really worth it? Is THIS worth the children's money paying all these bills? Is THIS really worth the stress? Normal people would get MUCH more out of this in terms of feeling some closure with this incident if she would simply call Jon up, invite him to lunch and hash this all out. Heck if a normal person did this they might end up shaking his hand and even giving him a hug at the end of it all, everything resolved. It's amazing what you can work out over lunch.

People had more or less forgotten Robert's book. Now a whole new crop of people will know. Is that the intent of this?

I always thought those text messages were too perfect. First I'm gonna do this then do that and the murder weapon is under the armoire in the red bedroom, I hope no one dusts the mantel for fingerprints where I left them! Gimme a break. Plus they only prove if true the idea was being considered, not that it actually happened. And why did Hailey run scared from it and threaten to sue Kate if she used them if they were so true? What's she so afraid of?

Not to mention, text messages are hard to get into evidence, although it's possible. The problem is, it's hard to authenticate them unless the person admit is--i.e. prove that you actually sent them.

For instance, we know Hailey had her issues with Jon. He could have left his phone on the counter while showering and she could have taken it and sent the text messages herself.

That scenario is obviously not likely, but the other side will surely be objecting and from an attorney standpoint, you have to figure out a way around that to even get these things into evidence in the first place. Email comes with the same problems. You can have all the damning emails in the world but unless you can prove who sent them, they're worthless.

If secret bank accounts come out in this mess, can the division of assets in the divorce be revisited? Somehow she thinks she will always win. The attorneys she has now are not the same caliber as Laverne and Shirley. Why is she demanding a jury for a civil matter?

Realitytvkids.com ~ Administrator said...

Paper yes. I think the problem Kate will have is that she can't show damages. None of what happened to her can really be strongly tied to this incident.

Plus most tellingly, ABC which is a very family friendly network and will fire people in a heartbeat, had no problem keeping Kate on board right after the incident came out. If even ABC won't fire you how can you possibly say this has hurt her? She gets work, she gets on the cover of People. Not a single person has said oh Kate I won't hire her because of the child abuse. While I find that rather sad, it sure does leave her case dead in the water.

CC and the Stir didn't even so much as HINT that any of their firing had anything to do with the book. In hindsight it was rather wise of Scott to write that letter and lay out exactly why she was fired. That letter makes it crystal clear it was Kate's OWN ACTIONS that promoted it, and had absolutely nothing, zero, to do with any fan, non-fan, Robert, Jon, or anyone else outside of Kate herself.

Again, the book could have been forgotten by now if she just let it be.

Exactly!

The same thing happened to Paula Deen at a much faster rate. People HATED her. For about a week. Then it felt like piling on. People started to feel bad. People started to feel like, while this is horrific, there is no need to pile on. The point was made, now let the woman have her day in court. Back off. It had nothing to do with feeling like she was right and everything to do with wanting the punishment to fit the crime.

This is exactly what is happening here. My impression of what I have read of the "public opinion" is this: Sure Kate yes you were right Jon WAS a deadbeat. Absolutely. But now you've gone too far with it and that's not cool so knock it off. The punishment does not fit the crime. He's just a deadbeat, not Jeffrey Dorner. There is no reason to PILE ON."
