I am very familiar with the Betty Broderick case. I have letters from her. She STILL blames Dan for her circumstances. She is the victim and he deserved to die -- her stance.

One of her letters is so full of anger that the punctuation on fierce sentences actually pierces the lined paper.

I think there are parallels in the Kate/Betty story.

Because private citizens can't sue criminally. Prosecutors decide that. You can alert them and ask them to sue, but the decision to go after someone criminally is up to the prosecutor's office, not Kate. I guess no meant no to them. Her only option if she is not happy with the prosecutor's decision is to then sue him herself in civil court.

The easiest way to understand this is the OJ case. The state of CA went after him criminally. But Nicole's family went after him civilly.

How sad that the kids have to deal with this on their first day of school. The twins must be absolutely mortified. I'm glad to see the humor here--but, mostly I am just very sad.

Yes. I've always felt that way...the snark is fun, but at the end all I feel is sad for the children.

It is indeed very sad, heartbreaking really, she had to do this just when they are back to school, and the great publicity stunt that backfired on her means that now the kids are probably hearing just as much hazing about their mother as their father who is the target of this in the first place.

On the flip side, maybe they need to hear this. They just might come home and shake some sense into Kate. They are plenty old enough to understand she is being made a fool of, and to be terribly upset about that and plead with her to stop. I doubt she would listen, but you never know. It's worth a shot.

The first day of school should be all about them. Now, it's going to be all about their parents. So f-ed up.

I like how GMA showed all the worst clips of TFW being a total shrew, and made sure to emphasize that this is all over accusations of CHILD ABUSE.

I cannot imagine how many tens of thousands of people are now suddenly hearing this and getting curious about it. Child abuse? Exactly what did she do and how can I find out more?

Good job, Kate. Just, really good job here. The child abuse was FORGOTTEN. Forgotten!! Now it's front and center. What a fool she is. An utter fool.

If you look at her documented behavior, it's clear that she cares very deeply about what others (even strangers) think of her. Didn't Robert say that she used to keep a file on her PC with a list of the "bad blogs"? What other "celebrity" would go to such lengths to silence random Joe critics? Even her stupid cookbook makes it clear that she reads every single thing someone says about her, because it's full of sentence after sentence that addresses specific things people have said about her (I could list examples here, but then I'd have to go back and read the sample again). So if negative press bothered her before, you can bet it bothers her now, only now she doesn't have the might of TLC behind her to spin the stories in her favor.

When you think about it, it's actually quite sad and pity-inducing that she is so deeply insecure, isn't it?

What a mess. This isn't a small town in New Hampshire where it is illegal to go through trash left at the curb. So either Robert got it in the trash or he didn't. Sounds like they really aren't sure about anything.

I can't imagine what Razzmatazz thinks he'll learn in discovery that he doesn't already know. Kate says Jon stole a hard drive, Robert says he found the discs in the trash. He has a detailed diary of his exploits picking her trash and he took pictures. Unless there's security camera video showing Jon removing the hard drive and handing it to Robert, it's still a he said, she said case. And Robert said the discs have a sort of digital footprint on them that shows they weren't tampered with or updated. To top it off, there's even a police report (thanks to Kate) which can document his story that she wanted Jon out and vowed to throw away anything he left behind. If he has the discs and quoted her journal verbatim, they can't claim he defamed her. She defamed herself.

With all this negative publicity, what would be the chances of HCI cancelling her cookbook? Especially with sales numbers so low? Even if she is paying for all the costs up front, it can't be good for HCI to be associated with her?

I have no idea. He should have said no comment or at the most said Robert says he got it from the trash, my client adamantly denies that and we are confident we will prove otherwise.

This whole, oh we'll have to explore whether this trash thing mighta happened, is bizarre and just cracked open a huge weakness in their case. It's clear they don't know whatsoever. Sounds like they're just going by whatever convoluted story Kate told them and based a lawsuit around her paranoid fantasy of what MIGHT have happened. They don't seem to have the slightest proof that the original explanation of getting it from the trash isn't absolutely 100% true. They seem to just be hoping something will come out in discovery that supports their other bizarre contention.

As Dot said, it is a he said she said. It will simply come down to a credibility call. And you never want to base your whole case on a judge or jury making a simple credibility call. That's a crap shoot to try to avoid at all costs. You want PROOF.

I agree with what so many others have said here in that Kate thoroughly hates Jon. And the parallel with Kate and Betty Brodrick is scary.

The other thing I keep thinking about is Kate has only gone after Jon. She didn't sue CC when she was fired, or The Stir, or TLC. No, she goes after the person who was weak and without financial means to fight her. Only this time she miscalculated. Jon may not have the money to fight her but there are more people on his side than ever before. Jon is no longer weak (IMO) because she utterly and feciously destroyed him. He's ready for the fight. The other thing she miscaluated was the public's opinion of her. She thought she was all that and more, and could do not wrong. Ha! Based on what I've read, especially the comments, people are seeing through her lies and want her to disappear from public.

When this comes to trial, Kate will not be in the same position she was when she went through the divorce. People are done with her and Jon is ready for her. Dare I say Kate has met her Waterloo.

You are right, TLC must be getting a little pissed right now. I wonder if they will intervene. Indirectly, this comes back to them, because they had a child abuser on their payroll. If this gets out of control, at a certain point they may fear this is reflecting poorly on them. I wonder if they'll try to do anything.

It's strange how Hailey Glassman gave TFMJG those texts messages from Jon's phone then had a major meltdown when Kate talked about using them in a lawsuit. It seemed really odd that she'd threaten to sue TFMJG over using them in court when she's the one who gave them to her.

I've always thought the texts sounded fake, like Hailey took Jon's phone and sent them to her phone. They're too wordy and too incriminating. I bet a lawyer warned her that those had better be legit or she's in deep trouble and that caused her to freak out. Nothing else explains her reaction. Maybe it could be proven that Hailey's phone was in the same room as Jon's phone at the time they were sent. Stranger things have happened in this psychodrama.

Yes, she has seriously misjudged this one. Her mental illness has pushed her deep, deep in a hole, fueled by whom, close crazy internet friends? It is really obvious that there is no one in her life to keep her from doing ridiculous things. I would hope HCI will reconsider publishing this toxic mess.

I'll tell you what made no sense to me about the Hailey Glassman thing. She said her mother was upset and couldn't sleep, etc., and didn't want any more Gosselin drama in their lives. That was the reason Hailey gave for not cooperating with Kate, however within days she was telling Radar SHE was going to sue Kate. Isn't that bringing Gosselin drama into their lives? Why would her mother be okay with that? Something is definitely fishy.

I believe Kate thought the professionals on GMS and the Today Show and ET and AH etc, etc.. were her contemporaries, her equals and that what they did, she could do too. Just like that.
She's never been on equal footing. What she has been is a ratings draw to be used, then discarded like yesterday's newspaper.

It IS curious why she'd flip out when TFW said she wanted to use the texts in the lawsuit. I read about text "spoofing". Is it possible Hailey might have done this and why BV said he can "verify" that it is indeed Jon's number? Would she have known how to do that, or been shown by a techie how to do it?

And here's where one gets into the psychological/sociological aspect of it. She's become a laughingstock. People are fed up with her, as evidenced by the negative comments both after she was on the magazine cover last week, and now in the wake of the lawsuit. And still, there are some die-hard fans who either aren't aware of the backlash she's receiving, or they do know, and they still proclaim her the most awesome mom on the planet. To them, she walks on water. They want to be just like her. Why? Young and gullible, maybe, and immaturity goes along with it, but what about the adults? Are they still stuck at a place where they think like teens?

What is it in their brains that just won't allow them to take a critical look at her and her actions? I do believe, though, that after this, fans will be dropping like flies. Moreover, there is a sub group of fans who, although they may have started out in their defense of Kate, moved on to this fight with the haters, and the fascination with Kate took a back seat...the whole RWA thing, who did what to whom, who outed whom, who stole passwords to blog sites, the general infighting. For them, Kate and the kids are secondary...it's this online battle, tearing one another apart that preoccupies them.

Then you have yet another sub group -- the BV gang and the fans who have aligned themselves with him and salute his outings and tactics. I don't think this really has anything to do with Kate per se, but rather they think that because they've become members of his select group, they're tough...in the in-crowd (especially the one fan who couldn't make up her mind which side she was on). Tough talk, obscenities, the more the better, and they're happy campers.

It's fascinating the way this thing is unfolding. What's tragic is that the children are helpless victims in all of it, pawns in this whole horrible game that her actions are responsible for setting into motion.

I never believed TLC, the crew and the entire editing team didn't see abuse. Too long hours, repeating scenes, staging scenes, and probably seeing corporal punishment.
Not only did they have a child abuser on their payroll, but they had a pedophile too.
Here's a scoop-- did TLC have a pedophile employed (or Figure 8 Productions, which edited the footage), who had access to any and all footage of the kids, while he was under investigation by the FBI?

I imagine this very sad event, my husband, the father of our children, after having gone through so much together, he is leaving for good, he is carrying his belongings down from over the garage in trash bags and boxes, it is raining. He has one friend helping him. So what do I do? With the children in the house, rain, night, end of a marriage, belongings in trash bags, I would be on my bed in tears, or have left the house. The thing I would never do is escalate the misery by calling the police because his lone friend helping him through this task at one of the lowest points in his life is a reporter. Makes my blood run cold.
With that kind of vengeance I have to believe she demanded action from her attorneys back in 2009 when she discovered the alleged "hacking" and they said no.
It seems she won't be happy until he is destroyed.
This is all a result of her actions.

TFW has made a tactical mistake by filing this SLAPP suit. Now she is being tried in the court of public opinion and it's not a pretty sight. The entertainment industry has gone from looking at her as a joke to realizing she is extremely litigious. She has way too much baggage to ever get a show of her own and if she has plans for Mady I don't think that will work out. Agents and Producers will be very aware that Mady's mother is sue happy and they'll simply move on to the next candidate. The Industry is rather insular and people talk, she's given them plenty to talk about now. TFW you overplayed your hand. You did this to yourself and no good will ever come from it.

TFW uses a lot of victim words and it seems now not only her critics, but the media and social media aren't buying it. "Bullied," "haters," single-mom," "survivor," and alleging her then husband "hacked" her computer in 2009.
Knowing they were headed for divorce, and the computer was part of the personal property within their home, and the content of the information within the computer, I think most adults will identify with Jon. With the knowledge that some very expensive, very powerful attorneys are being paid for by the media outlet and suing you for $500k, who in their right mind would leave without taking such information?
I think this suit is an enormous mistake.

If this case were to go to trial, I would suggest that Jon demand a trial by jury. Kate is immensely unlikeable. Jon is almost the opposite, as most people find him likeable or at least pleasant and cordial. Years ago, an attorney I worked for had a case where the plaintiffs were very sympathetic but had a weak case. However, one of the defense witnesses made a terrible impression on the jury. She was an attractive woman in her 40's, and she came across as snotty, full of herself, cold and uncaring. The jury found in favor for the plaintiff and awarded a huge amount in damages. I believe this was in no small part to really, really disliking this defense witness.

Let the jury hear testimony from both Kate and Jon, and let's see which one they would rather believe: the cold, calculating, full of herself Kate; or the soft-spoken, friendly and sympathetic Jon.

I Googled Betty Broderick parole to see when she was last denied parole. It was late 2011 and this is what they said in denying her parole:

"Your heart is still bitter, and you are still angry, said Board of Prison Terms Commissioner Robert Doyle. He continued, "You show no significant progress in evolving. You are still back 20 years ago in that same mode. You've got to move on."

Can you imagine still carrying that kind of anger 22 years after the death of the person you feel caused that anger?

I agree. I think she really thought that people would be sympathetic to her plight as a "single mom" of 8 just trying "piece and patch" together an income to provide for her family.

She totally underestimated the public's bullshit tolerance level. You can only cry wolf so many times before the villagers start ignoring you.

And really, how many people knew about Mr. Hoffman's book before she filed the lawsuit?

And how many know about it now?

I wish Jon could get 100% custody of the children. I do worry so much for them and their safety when they are with their mother. She is going deeper and deeper into mental illness. She has no one left who can control her, like "head of security" Skeeve.

Mental illness, left untreated, only gets worse and worse. Maybe the filing of this lawsuit, the subsequent publishing of Hoffman's reconfigured book, and other evidence of instability would encourage the family law judge to agree to give Jon full custody, if he asked for it.

Wheat bread is definitely better than white bread and contains more nutrients. I'd have to actually see the bread provided, because many wheat breads are quite delicious. As to the milk choices, I'm not sure. My child is approaching age 16. He's always been skinny. His metabolism burns at a high rate. So he gets whole milk, because he needs those calories.

I still pack a lunch for my son because he doesn't like cafeteria food. If I were a parent on the lunch program, I think I might pack some extra choices for my child, to supplement the lunch program. Some pretzels, a bagel w/cream cheese, half a sandwich, whatever.

I know childhood obesity is a problem in this country, but I think it's more than just simple eating habits. Kids are more sedentary, what with the advent of video games, 100's of channels on TV, etc. Not to mention, eating lots more fast food and having soda, chips, etc.

When I was a child, having a meal from McDonald's or A&W was an occasional, special thing. I doubt we were treated to McDonald's more than once a month, if that. Soda was also an occasional special beverage, saved for a birthday party or something similar. Otherwise, we had milk or water, and orange juice (small glass) for breakfast. The first time I saw a family sit down to dinner and pour soda into their glasses, I was shocked. I had never seen such a thing!

In this clip, at 15:11 you can hear them tell Leah not to put her hand in her mouth and when she does it again, there is a sudden cut and next thing you know, Leah is crying, holding her arm, while Kate's hand is withdrawing.She clearly smacked her:

Marie, my guess is that Robert has worked with attorneys to make sure this time his book passes muster. People write unauthorized biographies all the time. What killed Robert, IMO, were his personal comments instead of just stating the facts and letting the reader draw their own conclusions.

I would think Jon could write his own autobiography or memoir as he sees fit. It's his life and his recollections and his opinions. However, an attorney would probably discourage him with a lawsuit hanging over his head to release anything at present. It's a delay tactic on Kate's part to file a lawsuit and I suspect she has applied pressure on him to never write about their life.

Get the kids opinion, of what they want to serve. It would have been easier to test it first(then all the food that was tossed out), then work with what the kids want and what the program wants them to eat and then compromise. I saw in I think it was an ABC report on how much food ended up in the garbage, uneaten. It was a lot. These programs have to understand that a lot of those kids, never had a lot of the food they are tryin get them to eat. It's one thing to have them try a sample, it's another to get them to actually eat a plate full. I've worked with kids around 7-10 years old and a lot of them never had fresh veggies, at home food came from cans or they never eat fresh veggies at home, a lot of them eat rice, beans, tomato sauce, ground beef, fast foods that is it. Serving kids, who may never have eaten anything else, puts the program up for failure. If they never had these veggies or wheat bread, they will not eat it. The compromise is to introduce the healthier food a little at a time. Like a sample. Shroving healthy food all at once does not work.

Kate, with what you are doing you are proving without a doubt that you are A BAD MOM.

If I had the resources that you supposedly have, I would enjoy every minute with my kids. I would be volunteering at the school, taking them to sports events, enrolling them in activities they enjoy. Time with your kids goes so fast so just spend as much time as you can with them.

Go back to school and take courses that will benefit you in the future so that you will have a solid occupation when the kids are grown.

Spending time trying to take down the father of your children is so pointless and unnecessarily malicious not to mention you are drowning in spite and stress which does no good for anyone.

Focus on those kids and not on perceived slights or your own desperate agenda.

I have no idea. He should have said no comment or at the most said Robert says he got it from the trash, my client adamantly denies that and we are confident we will prove otherwise.

This whole, oh we'll have to explore whether this trash thing mighta happened, is bizarre and just cracked open a huge weakness in their case. It's clear they don't know whatsoever. Sounds like they're just going by whatever convoluted story Kate told them and based a lawsuit around her paranoid fantasy of what MIGHT have happened. It's stuff Jon legally had access to because it was joint marital property. And because of this, this is probably why TFW could get no criminal charges filed against Robert or Jon. They got her. They got her. To help qwell her seething rage from being gotten, it makes her feel better to file a SLAPP suit and go along with some invented texts. Seriously? If this coffin nailing information was obtained in October 2009, why would Robert/Jon wait until September of 2012 to release it?

Jon has said nothing and I hope he continues to do so. The longer he remains silent, the more people see her true colors. If he made a statement, people would jump all over it. But his silence causes them to analyze and jump all over her. He certainly can't be accused of going along with this for more publicity for himself, as he's been accused of in the past.

Just watched the Fox video and the GMA video. It's officially official. TFMJG is a laughingstock. I loved when the reporter at GMA ended his segment by saying TFMJG claims Jon ruined her reputation and Elizabeth Vargas says, "Just now from the book," and all the cohosts laugh. Yeah TFMJG, Jon ruined your reputation and you had absolutely nothing to do with it. And you need to remember TFMJG, that discovery goes both ways. When your Atty. Ratmatazz explores whether Robert Hoffmann legally got your disks out of the trash, you will be subjected to discovery as well. Have fun with that. My sister-in-law's mother was from Hardin Co. Kentucky, a very lovely rural part of the state.
The people were wonderfully warm and friendly to me, and I assume they are to everyone. And they enjoy their food! You know the Drive-Ins,
Diners and Dives that Guy Fieri visits? They love those kinds of places. Meatloaf, gravy,
potatoes, gravy, green beans, rolls, fried chicken, cornbread, beans and cornbread, kale,
collard greens, and pie. Down home comfort food. They don't have any more cases of obesity than city dwellers who eat fancier foods. I can understand the kids don't want to give up their shepherd's pie in favor of pita sandwiches with spinach. They don't know what to make of some of the "fancy food", and if they can't pronounce it, they're sure not going to eat it! (Baguette, focaccia, quinoa, whatever.) They like meat, taters, gravy and
pie. No complaints, they promise.

They're not going to change because somebody thinks they ought to. They like what they like and what they're used to. It's part of who they are. There will be war if somebody tries to take away their sausage and biscuits!

Could not agree more.
I've wanted to say that I wish Jon strength in this marathon that is surviving TFW's abuse, losing himself, finding and centering himself again and striving all the while to shield his children from all of it, as much as humanly possible.
I hope for Jon that he keeps himself surrounded by family and trusted friends, and that he might find support through his faith once again.

It must be very hard to not fight back, but it takes the bigger person to show restraint instead of giving in to the release of lashing out.

Yeah, Kate is looking pretty bad right now, and she needs no help in painting herself in a unkind light.

Until and unless Kate gets therapy-- real, professional help-- she will lead with her anger, which is really to say, pain.

I can only speak for my own mothering experience. By age 9, my son was taking his own baths. I would run the water and get it ready for him, then leave him to it. However, I did still check to be sure he got all the shampoo out of his hair.

As to staying up late into the night supposedly preparing all the kids' school materials - yet another example of what a crappy organizer Kate is. She doesn't work, she doesn't volunteer her time anywhere, she has no friends to go and visit -- so she's basically got all the time in the world to prepare the kids for back to school. Does she do it in an orderly fashion, over the two weeks preceding the first of school? Noooooooo, for some reason she puts it all off until the very night before school.

Why would I be impressed with that? I am far from being a Wonder Woman, but in the two weeks prior to school starting up again, I buy any necessary supplies. I used to organize my son's backpack, but now I just hand him the supplies and he puts everything in order.

Not that I believe Kate actually sat there and organized 8 backpacks. She probably created a 52-point chore chart for the kids, on how to organize their backpacks. If they missed any of the 52 points,she charged them a dollar. Soon, she'll be charging them for their food, laundry costs, their portion of the PG&E bill, etc.

Bubble baths! I grew up with bubble baths and never had a UTI. My girls have always had bubble baths, and no UTIs. Knock on wood...now watch it happen!

I think the jury is still out on that one. From what I've read, if the child is prone to infections, it's probably best to avoid bubble baths, especially if the child is under three. If kids are going to take them, you need to make sure that all of the soap is thoroughly washed off when they're finished because soap is an irritant. But just because a child "might" get a UTI really isn't any reason not to let them have an occasional bubble bath.

Heck, they can get a UTI just being in a wet swim suit at the pool. What's a parent to do? Bring dry swim suits along to the pool and have them change every hour on the hour? You just need to use good old-fashioned common sense.

As to staying up late into the night supposedly preparing all the kids' school materials - yet another example of what a crappy organizer Kate is. She doesn't work, she doesn't volunteer her time anywhere, she has no friends to go and visit -- so she's basically got all the time in the world to prepare the kids for back to school. Does she do it in an orderly fashion, over the two weeks preceding the first of school? Noooooooo, for some reason she puts it all off until the very night before school.

I looked at some of the videos from J&K+8 listed above, and all I can think is that there is no way that nasty, mean, abusive mother suddenly transformed into a joyous, cheerful, adoring mother who spends every waking moment doing wonderful things for her kids. Those kids have never come first with her. Her hatred, jealousy, and thirst for vengeance has always come first.

I find myself wondering if questions like that are stirring the pot, because it is difficult to believe that they are so unaware of what is actually happening. Here's an interesting thought.... since the media is now calling Kate out for what she is, how is this crookbook promo tour going to go? It seems that before, there was always the understanding that Ms. Gosselin would only answer a pre-submitted set of questions which portrayed her in only the brightest light. For some reason, I don't think she has the clout to make such a demand anymore.

Speaking of the crookbook, I sort of made the herbie chicken for dinner. I had boneless chicken tenders and I gave them a light dusting of seasoned flour before sauteeing. I like chicken to have a light crust when it's going to be simmered in a liquid, I think it holds the juices in. I doubled the recipe because I wanted to have enough for leftovers. I didn't have shallots so I sliced a large onion very thinly. I ignored most of her herb suggestions and amounts and used a lighter hand with seasonings we enjoy, like majoram. I served it with smashed baby red potatoes and fresh green beans. My family devoured it and there are no leftovers. It was quite tasty. I know I doubled the recipe but it made a ton of sauce which was delicious over the potatoes. She says the let the broth and wine reduce down to a 1/2 cup. Why? I let it reduce some, not until the pan was almost dry. As with most of her recipes, this one is an exact combination of 2 currently on AllRecipes.

I don't recall TFW making quinoa. I feel like I would have noticed that since I love it. Maybe I vaguely remember some dumped on a sad little salad?

Why don't they just look at some of the good vegetarian blogs out there? There are hundreds of recipes and surely some are kid friendly. Kids might like it with a Mexican twist, or maybe with chicken. I don't know, it's not the most popular thing for kids and not necessary to make them eat it. Making kids eat something like that is a surefire way to turn kids off from all healthy food in general.

Which reminds me, I find this transition to healthier school lunches so interesting and I've always followed it. In some communities it will be smoother than others. It is a very, very difficult thing to change the diets of kids used to certain things and as someone else mentioned, it's set up to fail and then the big junk food companies can say see we told you, kids won't eat it. I almost wonder if there's got to be some tough love here. I know you don't like it, but you'll get used to it. Offer them a wide variety of choices that are well prepared, but make it clear this is how it's gonna be and it will be fine. It's like switching to skim milk. It tastes like water at first and you want to forget that change. But if you stick with it, it tastes fine eventually and then the milk you used to drink tastes gross.

She hasn't said a word about Kate's book yet. Maybe she waits until they're nearing release or something.

One other thing...I went to TFW's blog for the first time the other day. Now I'm no web designer but I do know that if you right-click when over the web page then select View Source, you can see the html for the page. If you do that then go to the very bottom, the hit counter looks weird. It almost appears that there are several on there. If someone out there that is more web-savvy could take a look and comment, maybe we could clear up that issue. The counter definitly does go up in multiples of hits each time you refresh the page. And it seems to go up in a random amount so as not to appear rigged.

PJ I actually really believe in all seriousness Kate did NOT buy HCI's promotion package. I think she has separate people running the PR aspect of this, people she's known before who helped her. Perhaps that was part of her negotiation of the package. I think HCI would have said a lot more by now. Even though this book isn't much, it's really better than most everything else they've got to offer.

There's something in their brain wiring that, no matter how many times you try to explain something (even in the most simple terms) they can't get it. Wouldn't you think, though, that they at least could google criminal charges vs.civil suits and why there isn't any prosecutor involved in this particular action? No, it's not possible. My sister has had NPD, Bipolar Disorder, ADHD since birth. The characteristic of a borderline personality is extreme highs and lows. Everyone suffers around them, when they are miserable. TFW is likely up late in the night, crying her eyes out in a manic state. The obvious cure is having emotional support. TFW has cut everyone off. Imagine becoming a new lover or even worse... her BFF. Ugh- SWF comes to mind.

Hoffman won't post or talk, until he absolutely has to-- I think. He wants TFMJG to wait it out. I love his style.

Sorry Kate, but a Federal District court has NO JURISDICTION whatsoever with state laws.

A Federal District Court cannot grant compensation based on state statute. It's a violation of the 10th Amendment plus other Constitutional case laws.

Whoa, you're right. UNLESS there is no particular federal statute that covers that cause of action. Then I think they can use state law. Basically I believe it's federal law applies first unless no federal law exists, then you can stop down to state law.

Speaking in that same vein, I'm pretty sure they have to follow whatever the federal SOL is for the fed provisions they are citing. It would be irrelevant what PA's SOL is.

That's another thing. What are her "damages" in this suit, really. You can't break a plate that's already broken. She may have a heck of a time proving damages beyond anything but the fair market value of the electronics, and even then there's a fair argument Jon had every right to take those, both because it was martial property and because it was by the side of the road.

Someone asked in this last set about how soon there would be a court hearing. Jon and Robert proably have 30 days from personal service of the summons and complaint to file their answers and their respective attorneys may file paperwork to dismiss the case for various reasons, Statute of Limitations for one. Otherwise there isn't likely to be a court hearing until after all the discovery, interrogatories, depositions and the like have been completed. I've been out of the field for 15 years so possibly my view is outdated. And Federal court may work differently than state. So much is electronically done these days ...

I have seen those cardboard things. They are what fabric rolls are on. They are thick and have a sting to them when they are smacked against you...and they do not break easily. we have had to use a saw to cut them up.

It's a cardboard cylinder of a plastic stretch wrap roll like Saran Wrap. They are more dense and much harder than a paper towel roll cylinder and probably have the same spanker effect as the wooden spoon if you were wacked with it. Ouch.

I believe the judge will either hear this lawsuit minus the PA law or send it to PA court minus the Federal law. She can't have it both ways. (Dear sheeple, they call this double jeopardy.)

That could be difficult to explain if it was "discovered" doncha think? I mean I'm a mom and I didn't carry one of those around with me, keep it by my side when I was sitting in my lounge chair. Whatever could be the reason? Hmmmmm.

Dmasy, I meant to mention this before, but I love the multiple socks in your new avatar!
I was just reading some info from federal court website, basic stuff about what happens in a case before it even makes it to trial. It could be months before the defendants respond, usually its 30 days but the court website said more time can be requested. If it got dismissed even that might take several months. If.it ever went to trial, which seems doubtful thanks to info all the informed posters here have noted, all the kids could be teenagers by then! Theses things can drag on for years and years! TFMJG probably assumed that as soon as things were filed, she would get immediate satisfaction.
Looking at the Paula Deen case, it was fully over one year from the date of filing when discovery was still going on. That Paula Deen lawyers baked at. That caused Lisa Jackson lawyers to carry out actions they warned about before the case was even filed. Those actions were to TELL THE TRUTH. and to make sure Paula Deen s own words from her own deposition were circulated far and wide.
Oh my goodness. TFMJG will have to sit for a deposition too. Her own words will deliver the final blow to her ” career”.
I loved the clips GMA picked to show today. Even anyone who had never seen her before would think that she was the most annoying woman on earth after seeing those clips.
When the new DWTS cat is announce, you just know someone on GMA is going to ask Tony how he ever put up with her. And of he refrains from answering, someone will joke that he is afraid of TFMJG suing him too! Oh my, TFMJG has no idea of what she has done.
