Breaking news: Kate files suit against Jon

Jon and Robert most probably do not have the funds to successfully battle this in court. But maybe Robert's publishing compagny does. In fact, if I were Robert's publisher I'd almost be giddy right now. You cannot buy this kind of publicity.

I'm thinking along the lines of the book written by General Petraeus' mistress published just a short while after Petraeus had to resign.

Yes, I know, I'm comparing the head of the CIA with TFW. But still... Strickly "publishing wise", a suit like that, when a book about the plaintiff is all ready and set to hit the shelves must be a dream come true to any publishing house.

Statute of Limitation under Computer Fraud and Abuse Act (CFAA) is 2 years from either the event or discovery of the damage.

But they have this lumped together, along with ID theft, and the SOL in PA is four years for ID theft. However, the SOL in a CFAA, which is the invasion of privacy claim would fall under state law, and the statute of limitations is one year. The federal computer fraud claim has a two year statute of limitations.

So if they go by the SOL for the CFAA, she's out of luck if she knew about this in 2009.

Generally there are no residuals for those involved in reality television shows. Whether or not her attorneys wrote them into the contract is anyone's guess.

I think the new cover for Mr. Hoffman's book is brilliant. Visually, it's very effective.

The image is also an excellent representation of how this is all very much a chess game with 8 children as pawns and their privacy as collateral damage.

Whether Mr. Hoffman had intended to re-release the book and advertise said intent today becomes a moot point.

Kate filed the lawsuit first and that makes her look like the aggressor. The way it's played out is that Mr. Hoffman was merely making a defensive counter move.

As far as Kate filing the lawsuit, I have no legal knowledge whatsoever and can't speculate whether she has a case or not or how this could potentially play out.

What I'm pretty sure of though is that again Kate is most definitely putting herself before the well being of her children.

And, sadly, in the end, it will be the Gosselin children bearing the emotional brunt of this entire saga.

Also, I might be missing something here, but 1) what does this suit have to do with custody arrangements, even if Jon were to be found guilty? If you are convicted of stealing a hard drive, you don't get to see your children anymore? and 2) how exactly does this suit engender interest in her cookbook?

I agree with this one. TFW was on camera pulling the "ain't I cute" stunt with the crew all the time. Not something you would do with a female crew (who would think, oh, gag me). \
That's something that you do with men. She was probably the only female on the set, I mean...the house, thus the ultra flirty behavior.

And we saw the same sort of vibe on Jon's personal videos from when they were first going together. That "ain't I cute" thing.

Admin - I agree with your assessment of the complaint. It's sloppy work, looks like it was thrown together hastily with little proof-reading, and weak on its allegations. I would like to see Jon and/or Robert hire a competent attorney, who will rip the many holes in this complaint to shreds.

I'm not in the industry, but from what I've read in various online forums is that reality tv stars do not get residuals from re-runs of their shows. They are paid a flat rate per episode - and it might be a flat rate per family (as in the Gosselin's case), or flat rate per person (as in the case of the Jersey Shore group). If the show is successful, then the stars can renegotiate for a higher fee per episode. But I've never heard of residuals for a reality tv show.

Even if there was a remote chance that Kate could get ''work'' for the kids, the chances of that now are slim and none.

She has now managed to make herself AND the kids unemployable for fear of lawsuits. I wonder if this will follow the kids into adulthood too. Any potential employer may not want to touch them out of fear of reprisal.

All I can see in the future for those poor children is lawsuits, embarrassment, and heartache.

Long Time Reader....I remember reading that residuals were not in their contracts. I've no idea why they would be so unaware of residuals, because it seems to me that everyone would know to not sign any contract that didn't include some sort of residual payments.

Even if the law suit goes nowhere, the depositions will be 'out there'. Paula Deen's problems were because someone leaked the depositions! What would be revealed in TFMJG's depositions would make Paula's problems seem like a walk in the park!

I can't believe she wouldn't see this coming. That Fox piece was scathing and the reports of using The Spanker was hit on hard. Robert was quoted as saying she used it for everything and anything.
In addition to now being exposed for her severely physically punishing the children, the anchors did not even try to to be "fair and balanced". They can't stand her and wonder why she won't go away.

I imagine Jon set up their home computer, e-mail accounts and all. So, it also figures that he helped Kate pick out passwords..that's how he knew what they are/were, not by hacking or stealing things.

And that's the issue with her. SHE DOESN'T THINK. Before you leap gung ho into something like this, you have to weigh the pros and cons. What are the consequences...is this really worth it in the long run? What might come out, and how am I going to defend that? She's so fast on the trigger with the "can we sue," finds an attorney who wants the money and publicity, and just goes for it. I just am amazed that she has nobody to advise her, or if she does, she doesn't listen.

I was just looking at Robert's book cover, which is PERFECT BTW, and noticed something. Six of the pawns are reflecting the image of the 'Queen'. The two in the back aren't, however. I wonder if this is a subtle message? I mean since the reflections seem to go all around the Queen except for the two? Just thinking, perhaps even over-thinking things, but still, one has to wonder.

Because she may have known before she made that statement in October 2009 she knew. She just said that in October. She didn't specify the exact date she found out. Could have been September, August or earlier who knows. Hence why I said she may have blown it.

Here's a blast form the past. The interview with Merideth Viera. TFW's infamous 'Purse full of Bills".
TFW admits to 11 joint accounts with Jon.
TFW admits to taking/moving $100000 out of their joing account 'Before' Jon had moved any money because she was afraid Jon 'might move money out of the account'.
TFW was told by her lawyers to put it back.
TFW goes on a media blitz when Jon does the same thing (moves money out of the account).
If Jon and TFW had 11 joint accounts, he should have been able to access them until they were dissolved and closed presumably when the divorce was finalized or around such time.
I believe Jon was afraid TFW was going to hide all the liquid assets without him having anything. She's just that vindictive.

Also, her complaint about "stolen" emails doesn't hold much water, either. Many of the emails as presented in Robert's book were sent to both Kate AND Jon, or Jon was CC'ed, or they were sent to info@sixgosselins.com, which Jon was entitled to access.

First, I'm pretty sure that Kate's law team, which includes Randazza, would be fully aware of which SOL apply before filing the Complaint and making fools of themselves.

Second, I'm willing to bet prior to this getting to trial that most, if not all, of the "Does" will be dismissed from the case.

It's what's they are used to hearing. I have mine set to the British accent (Nigel) so it's really funny to hear them imitate the GPS voice.

This antagonism between these two factions on her TL just needs to end. Kate is doing a fine job all by herself digging herself into a hole from which she's not going to get herself out. She doesn't need help from the "haters" on Twitter, and no amount fans glorifying this lawsuit with the "Go Kate" garbage is going to redeem her or help her in any way.

Attorneys file complaints all the time that blow SOLs, it's just usually that becomes part of the argument, when did it toll. They may have some convoluted argument why she hasn't blown it but that doesn't mean a judge will buy it. It breaks my heart the way the children are probably paying for all this, and for what? To prove a point against their own biological father.

Because she may not have cut it close at all. It may be too late, depending on when she knew. If she knew back in April of 2009, but only commented on it in October of 2009, then the SOL has expired.

My take of this is simple. Kate believed Barbara Walters comment about Kate being a "star." Bad move on Kate's part. My dear husband said today, "the whole thing is the kids have lost their cute." Kate cannot handle the reality of the situation. This family had their 15 minutes of fame/tons of income. Should have saved it while you got it. Kate is angry about her own lack of a career on television. Anger and resentment on her part is behind all of this and Kate found an attorney who will gladly take the children's money. This lawsuit makes her look bad, very bad. We did not need a book to tell us about the secrets of Kate. She let out her true colors on the show, each and every program. Where are the "best friends" now? Where is the extended family? There are reasons for the disappearance of so many people.

I do not mean to speak for Admin, so this is my best guess response. It may be unclear as to when the activity leading to the cause of action was actually discovered. By cutting it close, could mean that further discovery as the lawsuit progresses could prove that the lawsuit wasn't filed prior to the running of that particular statute.

A complaint makes allegations. The discovery phase is where those allegations have to be supported by documented proof.

Not necessarily, Pat. I've seen cases filed in which the SOL had long expired, but the attorneys thought they could pull the wool over the eyes of the judge and opposition. Sometimes it works, but if opposing counsel is sharp, they won't get away with it. Doesn't hurt to try, though.

It is hard to find an attorney to actually file a civil lawsuit to sue on your behalf, even if you have the money to do so. It is not as easy as it sounds.

However, it is not as hard to find an attorney to defend you, civil or criminal. The odds in vegas are on J&R this time.

Remona, I thought of the phrase, "You can't get blood from a turnip." Jon made it very clear in that recent interview that he was not afraid of being sued, that he felt free, and that the most important thing to him is that his children have the freedom to be children.

He's been through the fire (or maybe a David v. Goliath reference would be more appropriate), and survived. Sounds like he has his priorities straight, and knows that Kate cannot take his own contentment with life, his own spirituality, whatever centers him - away from him at this point. He is free of her grip, once and for all.

Now his focus is on keeping his children from being made to work to support their lazy mother. Her lawsuit is not going to change a darn thing about that.

I truly do hope that Jon doesn't think that this is something he can go into court for, and defend himself. Robert, either.

There's way too much to lose. He isn't going to know about SOL, etc. He won't even begin to know the rules, etc. This is not the time to go it alone.

A good lawyer is needed. Emphasis on "good". Not like the incompetent nincompoops he had before.

This is it in a nutshell. Let TFW have her day in court if she wants it. No matter what happens Jon will still be Jon. He has nothing to lose, but TFW has EVERYTHING to lose (that she hasn't lost or thrown away already).
What I found interesting in that interview with Meredith in Oct 2009, Meredith said that Jon wanted a 90 day 'stay' or pause in the procedings to work out and mediate the situation. She asked if TFW would consider it. TFW hemmed and hawed and made up an excuse. She didn't want to fix anything. She wanted to continue to play the put-upon victim. Jon was willing to work things out (and I believe more than once). Meredith even said Jon wanted to apologize. TFW refused to acknowledge it.
TFW deserves every ounce of crap that has been flung at her through comments on a myriad of websites in the past two weeks as a result of her 'I'm a different person/where are they now' People interview and now with this SLAPP lawsuit.
Karma is a B*tch.

So here is in a nutshell what Jon and Robert are up against. PA has a very limited Anti-SLAPP law which does not apply to their circumstance. Randazza is noted as a First Amendment attorney but will file a SLAPP suit in a heartbeat. With high profile clients like Jon and Robert, I hope some big gun PA attorney takes their case pro bono to make an example of SLAPP abuse and the need to pass stricter anti-SLAPP law in PA.

It's a completely unrelated case about creditors, but in a CA appellate case that came out today an attorney got slammed for bringing a suit that subjected the other party to a "long, costly and completely meritless lawsuit."

I was involved in a lawsuit in KY. As to SOL, the law there states "when you knew or should have known" that such and such event took place.

That "should have known" adds a new dimension to
it, IMO.

So, if PA has the same wording, if TFW's lawyers are insisting that a hard drive was taken (and not just discs kept in the garage, tossed out) then TFW "should have known" within a week that her hard drive was gone. And that's when she should have called the police re: theft, letting them decide if it was actual theft or a husband taking what is his.

She "should have known" that same week.

It looks like she is really losing it. She has whipped herself into such a frenzy that she's not seeing straight. I think it's safe to say that nothing in her life is going the way she wants it to go. She was supposed to become rich and famous as a result of having those kids. She never considered the fact that the fame and the money wouldn't last. Now she's stuck in a small town in PA, divorced, alone, and unable to restart her "career". She has this image in her mind of herself in CA, living in a house like Kendra's, eternal sunshine, starring in movies and TV shows and basking in the glory of fame. But, of course, that's not her life. Who can she blame? It can't be her fault. It must be Jon's! He has ruined her life. It's just not possible that people got sick of her. It's not possible that she became known for her bad behavior. Oh, no, it's bad old Jon and his dastardly friend who are keeping her from the life she so richly deserves. She will skip into court, tell her sad story, and everything will go her way. Jon and Hoffman will be thrown in jail and she will finally be recognized as the most amazing-ish person on the planet. The red carpets will be rolled out, crowds will cheer for her wherever she goes, and she will be swamped with more show biz projects than she could ever sort through.

I know there are some people here who have also worked with the mentally ill.

When asked things like what do you want or why are you doing this, the mentally ill might often make a nonsensical, odd, delusional statement like "I just want him to know if he broke it he bought it." In an ID theft case I'm familiar with the Feds won't arrest anyone because they cannot know with certainly who did the hacking. If more than one other person COULD have had access to the computer, there is no way to prove who did what and who did nothing. Therefore, there have been no charges filed.

TFW had her friends staying in her room, house keepers, nannies, who knows who all COULD have
gone to her computer and hacked, especially if she had her passwords on little PostIt notes stuck to her desktop. While the kids slept, anybody could have done anything. While TFW was gone on a trip, anybody could have done anything. Since Jon was not the only other adult in that house who was a computer user, there may be no proof.

I suspect what happened was that at some point, Jon upgraded the hard drive to one with more memory. He backed the old drive onto the new one and probably didn't bother to erase the old hard drive.

Now if you are the wife of a computer engineer (like me), you probably have boxes and boxes of old, out dated cords, power supplies, cables, Zip drives, mice, or even hard drives. I suspect Jon had the hard drive amongst his computer stuff. Now, whether he gave the hard drive to Robert or not is anyone's guess.

But no where in the complaint did I read that the hard drive came from her computer. It was just a hard drive.

I think given that Jon likely handled the computer/technology stuff in their house, Kate's assertion that Jon was never given permission to use her passwords or logins is false. Kate's lawyer should have said "at no time since the separation was Jon given permission to use Kate's accounts".

My husband is somewhat familiar with Randazza's work and he said he finds it highly unlikely the complaint was written by him. It's not professional enough.

This is rather like when you bump into an old elementary school classmate who used to bully you. It's 20, 30, 50 years later. Often times, you just sort of laugh about it, shake hands, and end up perhaps even going to lunch. It would be silly to hold a grudge against that person and even sillier to continue to give them a hard time. We all have things in the past that were painful but to hold onto anything but the most heinous of grievances doesn't make you feel good and is just bad for your mental health.

Even parents of a child who is tragically killed are often quite willing to forgive the person who did it. And they of all people have every right to be angry the rest of these days. And yet time after time, watch the news and you hear from so many of these brave people, I've forgiven the killer, I don't hate them, I've moved on from them. My child would want me to forgive. What would the Gosselin kids say? Would they want Kate to forgive? I think so.

If even many of those parents recognize that it's just not healthy to go on hating that person even despite a MURDER, it just seems downright silly to continue to hate someone over a stupid hard drive or disks. And the public saw it, and has spoken.

That's just such an odd thing to say from her attorney. It makes no sense.

I really hope she is not implying he "broke" the family. Because if I'm not mistaken, it was Katie Irene Gosselin who filed for divorce, not Jon, who rather, was desperate to try to fix the marriage through serious therapy and so on, and that information is widely available and verifiable.

When I was a child and did not quite understand a whole lot, my father entered into a legal battle over the ownership of a business with his older brother. It took financial resources he/we did not have, forced the rest of his family to take sides (not his for the most part), and did not end well. It quite literally destroyed my father. I have no knowledge or contact with that side of my family.

So watching the mega bitch KG enter into yet another legal sparring war with the father of her children resonates with me in a way that perhaps makes me understand why I still come here to read about her. She is engaged in a process that could very easily destroy her children's lives, and for what? Bitter, bitter revenge? I only hope that it ends here and she finally is stopped, if only by the courts. She has no insight into her behavior, and will not listen to anyone, not that there are even people in her life who might be able to talk to her. As said above, she really, really needs help. Medical, psychological, take a number.

my final thoughts on this topic for tonight. I honestly believe that Kate got word that Robert was about to re-release "THE BOOK" and that's why she filed this suit. I mean if she has been so harmed why didn't she take action back in 2009 when her own Attorney at the time stated she was aware of the alleged acts. The only thing she did was when the first release came out was get TLC involved and THEY got the book removed until the courts paved the way for it's release or not. That seemed to quiet the beast(Kate) for a while. But, how dare Robert go ahead and do some revisions that protect TLC contracts, etc. and plan a relaunch of that awful book. How dare he do that to the high and mighty Katie Irene. I think she is running scared because she knows this book will eventually come out and she is pulling out all the stops to prevent that from happening. Personally, I think she has lost what's left of her mind and her dignity.

I think the destruction began the day she sold her family out to Figure 8 Production Company. I don't recall her ever putting the kids' well-being ahead of anything. She has two things on her brain - money and fame - and because she lacks the talent to recite the alphabet, she had to find a way get them both. The children provided the vehicle to get that.

The only saving grace left for that family is if Jon doesn't dis their mother when they are visiting him. I hope he is mature enough to hold his tongue about her. Then, even if they get the message subliminially, they will know who is really the one who is looking out for them. All the money in the world doesn't buy love and fame is fleeting. Where I live, the teachers want you to label everything! You don't have to put their name in blazing colors where everyone can see them. I put my kids names inside the backpack or their initials under the strap, initials inside the lunch box and initials on the labels inside their coats. Many kids have the same or similar jackets, etc. This helps the kids to make sure they have the correct belongings.

Re Milo : oh, no, she's back in full on gag. PS TFMJG did something mildly interesting today, but essentially she is still boring and will be overlooked in favor of #SuperFunSpanker discussion.
Also lawsuits take time and are mostly boring with waiting. So for anyone bored I can still give a virtual tour of state and national parks with alligators and crocodiles. Yes, there are some American crocodiles in Florida, however I never got close enough to learn how to tell the difference. Or we can go on virtual vacation. Or we can find the absolute best banana bread recipe ever! And debate the age old question: nuts or no nuts?
Don't forget #SuperFunLegalDefenseFund! I will contribute and I will bet there are quite a few readers of this blog and the news stories who will contribute.

Totally Off Topic for you Netflix watchers, if you like mysteries I'd recommend "The Fall." It takes place in Ireland, a tad gruesome but not overly so. Just a well put-together story with some good acting. Have I said lately how much I love Netflix?!

Guess tomorrow is the last day of summer 2013 vacation for the G8. Did she do anything with them, go anywhere? And I don't mean maybe taking the twins to see her sister months ago. Were they seen at a movie theatre, a museum, anyplace other than Chipotle? Guess she couldn't figure out a day trip to a park or a beach. What a shame.

It sure is amazing how fast information flows on the internet, so many people who are commenting about TFW's lawsuit, wishing she would just fly away already, and wanting to know the contents of Robert's first book, excited that he will be putting out a new one. Yes, so many of you are so right, she is calling major attention to Robert's first book, what a dumb-ass thing to do. She has painted a big red bulls-eye on her plastic chest, all the attention she wants is turning out to be the negative kind.
My husband bought a small commercial ice-cream maker, it is amazing to be able to concoct any kind we can imagine. He said it is because of our 5 grandchildren, but he has a wicked sweet tooth himself. Tonight I made a Raspberry Coconut blend, with a little Cream Cheese to make it a bit tangy, and it is really good! I am going to get a dish of it, and re-read Robert's first book again, getting ready for the second one. Goodnight all:)

"Students in a rural Kentucky county — and their parents — are the latest to join a growing national chorus of scorn for the healthy school lunches touted by first lady Michelle Obama.

“They say it tastes like vomit,” said Harlan County Public Schools board member Myra Mosley at a contentious board meeting last week, reports The Harlan Daily Enterprise.

The growing body of USDA meal regulations implemented by the Department of Agriculture under the “Healthy, Hunger-Free Kids Act of 2010″ has long been a signature issue for the first lady.

Denizens of Harlan County don’t much care, though. Their primary concern at the board meeting was a bevy of complaints that local children are starving at lunch — and for the remainder of the school day — because the food on offer in the cafeteria is crappy and there isn’t nearly enough of it.

“Kids can’t learn when they’re hungry!” parents shouted to the board, according to the Enterprise.

Other gripes involved the new bread, which students don’t want to eat because it’s brown wheat bread, and the new milk, which is skim or one percent fat, not two percent or whole. The cafeteria’s chocolate- and strawberry-flavored milk offerings are now nonfat.

Jack Miniard, the school district’s director of school and community nutrition, was on hand to explain that the federal government now governs both food choices and portion sizes in most American school districts including Harlan County.

Under the National School Lunch Program, Under the Healthy, Hunger-Free Kids Act, participating schools must provide lunches — including free or reduced price lunches — with minimum amounts of fresh fruits, fresh vegetables and whole grains. Also, in what presumably falls outside the hunger-free aspect of the act, there’s a calorie cap: 850 for high school lunches, 700 for middle schools and a mere 650 calories for kids in elementary school.

Students can only have one serving of meat or other protein. However, rich kids can buy a second portion each day on their own dime.

Servings of carbohydrates such as potatoes are limited to just a single serving of three-fourths of a cup per student.

On the plus side, students can eat as many fruits and vegetables as they want.

Across the country, students and parents have expressed dissatisfaction with the federal government’s new food regime. Some wealthier suburban school districts are simply backing out of the National School Lunch Program, though doing so can mean giving up a six-figure annual subsidy for the district"

I really do fear for the kids' safety if this does not go TFW's way. I believe that she is will lose it--Revenge seems to be her only reason for living--what will be her next move?

How sad that the kids have to deal with this on their first day of school. The twins must be absolutely mortified. I'm glad to see the humor here--but, mostly I am just very sad.

I cannot believe Kate has filed this lawsuit. I believe she hates Jon, blames him for all that has gone wrong, blah blah blah. I know she acts before she thinks. I know she's used bad judgement. But I never thought she was completely stupid which is what this lawsuit seem to be, IMO.

I can't believe that she's so vengeful that she can't see that this is drawing attention to the very thing she wants to be rid of, but apparently she is. It is worrisome.

I think the new book cover is fantastic! I didn't get to buy it before, but I'm definitely going to get it as soon as Robert re-releases it.

Most people get it. Who on earth told her this was a good idea? What businessperson in their right mind is going to hire her with this baggage. Something struck me that Carrie Ann said, she honestly believed that Kate thought she was doing well dancing and that she had no self awareness of the reality. I think that is her downfall and you couple that with yes people who are ready willing and able to take your money, it is a big lose.......for the children. It is quite sad. Westbrooke

TFW's claiming the computer was worth $5K is a huge stretch. The only way to drop $5K on a computer is to buy either a workstation or a high-end gaming PC. So unless TFW has been spending her "working" hours doing computer-aided design or playing Gears of War on a machine rigged with a multi-monitor setup and multiple graphics cards, she's going to have a hard time collecting anything north of $1500 for a replacement computer.

They had a segment on about Kate's lawsuit and the guy says "Kate is asking for an undisclosed sum because Jon ruined her reputation." I swear everyone on the panel were like WHAT! you mean since the book, not all that was seen on the reality show. They were basically laughing at her. If any way you can all see it it is priceless.

TLC I 100% agree. This was all calculated with its own set of ulterior motives. The problem is as the years go by she loses it more and more, the longer she goes without help for her mental illness(es) she becomes more unhinged, and doesn't have her regular handles around with more level heads (she's gone from more grounded and rational people at TLC and Steve who said she couldn't have Nobu, to McGibblets). What's next, suing her own kids? Maybe there's a tort out there for not being cute enough anymore to be on T.V. The tort of mediocrity?

How's this for speculation?
I read today that Star magazine (I know, I know!) is revealing 3 contestants who have reportedly signed on to do DWTS this season, including Snooki, Jack Osbourne and another young chippie I've never heard of.
So, maybe Jon was being considering for DWTS and Kate's trying to keep him so wrapped up in a lawsuit, that she basically forces him to forfeit his opportunity.
Didn't Jon bring up Kate's never being at home for the kids when she was doing DWTS and try to shift custody then? I just remember her boohooing in a big-ass limo, sitting there like a lump and being handled by Steve to put her big girl panties on.

Oh speaking of suing your kids I heard that Shirley McClaine's daughter is sort of cow towing now and being wishy washy about all the dirt she revealed about her mom. I don't know if she's really taken it back but she's definitely acting like well maybe I exaggerated. I believe what she said the first time, and I fear her mother may have threatened or blackmailed her to get her to take this all back.

That's probably what TFW would do if the kids ever speak out until they agree to retract it.

She really seems to becoming unhinged, like Betty Broderick slowly did over time, over many years. Each behavior was more and more outrageous until it ended it tragedy. I'm not saying it's going that way, but it's certainly not going in a very positive direction, that's for sure.

Terri, I saw GMA! It was great!

They started by showing clips of her nagging Jon half to death and giving her trademark dirty, nasty looks, then they juxtaposed it with Kate's claim that the book damaged her reputation. They were all laughing and saying, Oh, so THAT'S what caused it." She is a joke. The entire panel was laughing at her in a very derisive manner. She is hated and they don't have to pretend anymore. It was wonderful to see them done with the ass-kissing and letting their real feelings show, in a way that can only be done when they know it's over for her.

They showed a short blurb from Randazza talking about discovery but they didn't even mention his name. He won't be getting a name for himself from this joke of a case. Oh, and no mention of the crazy one who started this whole thing with Kate. He thought his lawyer would work magic for Kate instead he is a laughingstock.

The parallels are creepy: Hated their father even though normal people thought he was a nice guy, had a very nice life with money and a nice house but still couldn't be happy and content, COULDN'T MOVE ON from what happened even 5 years later, narcissism. TFW needs to stop and get therapy. It's not going to end in murder God forbid, but that doesn't mean there aren't lessons to be learned from Betty Broderick. If SHE had gotten help maybe this wouldn't have happened. The reality is it's probably not going to end well in some form, if this continues without TFW getting help.

Don't they normally charge all identify theft and hacking in a Federal court? I had someone steal my identity a few years ago and they were tried in a Federal Court. But that was a criminal case. I don't know about civil cases.

I'm not sure where I read that, but if the complaint states that their names and addresses are unknown, then how to do they know that they are all from PA?

Oh and as far as I'm concerned suing the children's father is part of this "not ending well." This is not ending well. And it needs to stop before something worse happens.

I believe there are probably both federal and state hacking and identity theft laws that would apply here. For whatever strategic reasons, they are attacking this under federal law. Most likely, because if any of it didn't occur in PA's jurisdiction, they're still covered. It's still a civil case.

Unfortunately, personality disorders are part of who the person is. It would be like trying to change the color of her eyes. Her personality is toxic and destroys everyone in her path. The only way to protect yourself is to stay far away. Unfortunately, eight kids and their father have to deal with her, at least until they're adults. Can you imagine family weddings, grandchildren's birthdays? This is a true tragedy.

They started by showing clips of her nagging Jon half to death and giving her trademark dirty, nasty looks, then they juxtaposed it with Kate's claim that the book damaged her reputation. They were all laughing and saying, Oh, so THAT'S what caused it." She is a joke. The entire panel was laughing at her in a very derisive manner. She is hated and they don't have to pretend anymore.

Razamataze is being even more wishy washy this morning. Did you see the part where he said they claim they got the info from the trash and we look forward to exploring that in discovery?

What does that mean? What happened to, oh there's no way he could have gotten this from the trash the documents were too numerous? Now we're going to "explore" the possibility? LOL. Wait, wouldn't that throw the whole thing out if when they explore this in discovery, it comes out it actually did come from the trash just like he said? Like I said, lawsuits should always be taken seriously, but it's hard not to notice what a total joke this has become.

This might be a stupid question or already answered, but why would TFW sue Jon civiilly and not criminally for the ID theft and hacking charges? Is it because maybe she has some conscience and doesn't want to send him to jail but just hurt him monetarily? Or is it easier to sue civilly?

I saw an interview a few years ago with Betty Broderick's youngest son. He said he still loves his mom but gets exhausted visiting her because after all these years, she still rages about Dan when he visits her. He said he doesn't get it at all. He's dead, she killed him, and all these years later she still talks as if she is the victim and is full of hatred towards the father of her children.

He even mentioned saying to her "he's dead, what more do you want" but gets nothing but rage in return. Sad, sad story.

I have gotten a tip via email that GMA may be doing more stories on this thing, so keep an eye out in future days.
